The latest batch of Hillary Clinton emails released by the State Department early Friday contain what may be the smoking gun that forces the Justice Department to charge the former secretary of state with a crime, according to former federal prosecutor Joseph diGenova."This is gigantic," said diGenova. "She caused to be removed a classified marking and then had it transmitted in an unencrypted manner. That is a felony. The removal of the classified marking is a federal crime. It is the same thing to order someone to do it as if she had done it herself."
On the June 17, 2011, email chain with senior State Department adviser Jake Sullivan, Clinton apparently asked Sullivan to change the marking on classified information so that it is no longer flagged as classified.
Clinton, using her private email server, asks for "the TPs," apparently a reference to talking points being prepared for her. Sullivan, who is using his official State Department email, responds, "They say they've had issues sending secure fax. They're working on it." Clinton responds, "If they can't, turn into nonpaper w[ith] no identifying heading and send nonsecure."
It's not clear if Sullivan actually followed through on Clinton's orders. But if he did, it may expose Clinton to serious legal jeopardy.
"This makes it impossible for the bureau not to recommend charges," diGenova said of the FBI. "This makes it impossible not to go forward, and it certainly ties the hand of the attorney general."
Some have speculated that while the FBI may recommend charges, Attorney General Loretta Lynch might try to avoid doing so for political reasons.
The revelation also appears to put to the lie Clinton's claim that she never handled classified information on her server.
"I did not send nor receive anything that was classified at the time," she has claimed. By instructing her aide to send her material marked classified, it is clear that she not only may have received classified information, but that it was indeed "classified at the time."
"This means that when she said, 'I never received anything marked classified,' she in fact did," diGenova said.
David Bossie, president of the watchdog group Citizens United, said the email could become the emblem of Hillary's email scandal.
"It proves that Hillary Clinton affirmatively instructed senior staff to send classified data to an unsecured server," he said. "With that, it cements into history, much like the famous Bill Clinton finger wag."
I was wondering exactly the same thing. There is always a reason and I think we will figure it out when it’s too late.
We knew about this a long, long time ago but I guess they needed proof. Now that have it and I am sure barky is working on the pardon text and anicpating a nice fat retirement account courtesy of the Clinton Crime Family Foundation.

I believe the director of the originating agency for the classified document is the only one that can change the classification. I would suppose their boss could also change it. That is my recollection - if the NSA originates it another agency head cannot change it - it remains forever an NSA document.
Classified information is serious business and it has busted more than a few careers in government and led to imprisonment for far less than what she is alleged to have done. Based on everything I have read from reputable sources (not the hyperbole) is is abundantly clear that there were hundreds of violations in this circumstance. The idea of our Secretary of State using a private server (you KNOW it was hacked) is pretty ridiculous and politics be damned the intelligence community will not be quiet if they don’t charge her.
Of all the allegations against the Clintons over the years preceding his first term this could be the one. Did not think so at first, but it looks bad and it’s getting worse.

I bet they've known about this email for years. Did somebody leak to State that others know about this email forcing State to release it?
Has Hillary “lawyered up?” To me, that would be the surest tell that the government is preparing an indictment.

My opinion is we had a stolen election in 2012, by vote flipping in a few key states.
The Dems will do whatever it takes to stay in power. They have to, in order to hide their complicity in the massive theft of money and corrupt dealings that have gone on for the last 7 years.
We the people have to demand that Clinton be held accountable for her crimes. If that means she goes to prison and lives out her days there, so be it.
Yep, what shrillary has done is a slap in the face to everyone who has ever had a clearance, everyone in the military, everyone who keeps to the straight and narrow.
Consider this. The FBI has been around a whole lot longer than the muzzie up in the White House. They are good men and woman that became agents to uphold the law, to investigate and get to the truth.
I read an article a day or so ago that indicated the FBI was building a case against Clinton that will be irrefutable and impossible to NOT indict. The FBI gathers the facts/evidence and presents it to the Atty General. Despite what many believe, the FBI are pretty autonomous of the office of DOJ.
Exactly. She was expected receipt of this material... via secure fax. Other thoughts:
1. For anyone doubting, there's no reason to involve a secure transmission system unless the material in expressly classified. It's too much of a hassle to do otherwise. Such machines are supposed to be kept inside secured vaults... not just behind a simple locked office door, for instance.
1a. If there was any such transmission device kept anywhere other than a secured vault, then yes - another felony. And it does sound like that might have been the case, given the exchange in the emails.
2. The reason we aren't seeing the followup email to her is probably the obvious one: it likely contains the talking points she was after... which, of course, would have been classified and therefore was not released with the emails we're looking at here.
3. "Talking Points" are obviously just that - things for her to use when talking to the media... or, as we've seen, things to pass around to the media so that this arm of the Democrat party can be in lock-step with the administration they so much support. The question I would be asking is this: was she releasing classified information to the media via talking point memos???
4. Finally, does any of that sequence of emails shown seem 'routine' to any of you?... for it sure does to me.
Again... smacks of a routine operation.

Technically, if instructions were followed, it was not marked classified. The markings were removed.
Of course, it’s still classified.
