HARRISBURG, Pa. (AP) -- The state must restore the $4,900-a-month pension of former Penn State assistant football coach Jerry Sandusky that was taken away three years ago when he was sentenced to decades in prison on child molestation convictions, a court ordered Friday.
A Commonwealth Court panel ruled unanimously that the State Employees' Retirement Board wrongly concluded Sandusky was a Penn State employee when he committed the crimes that were the basis for the pension forfeiture.
"The board conflated the requirements that Mr. Sandusky engage in `work relating to' PSU and that he engage in that work `for' PSU," wrote Judge Dan Pellegrini. "Mr. Sandusky's performance of services that benefited PSU does not render him a PSU employee."
Sandusky, 71, collected a $148,000 lump sum payment upon retirement in 1999 and began receiving monthly payments of $4,900.

That will buy him a fair amount of protection.
Hopefully everyone in there will know that they can beat money out of him.
It will all be used to pay his victims.

They had to give him his pension.
It would have set a precedent that the public unions would never have agreed to
Whomever discovered him in that shower with the young boy should have beaten Sandusky to death with the nearest fire extinguisher.
Without absolutes, positive law can condemn an action that, next year, it mandates.
The "rule of law" under a positivist system is more of a whim than a rule - at the moment we are watching courts dismantle all cultural norms in real time.
A good absolute in any age would be that if you are convicted of raping children, your personal safety is forfeit.
The mileage of leftist judges and legislatures may vary.
I also see a good law in felons that have served their time as done with the government and all of their rights restored, including 2A rights.
