It is part of US code. The laws would have to be changed. I would like an end to birthright citizenship and Trump is really the only guy who makes a point of doing so. Rubio is against changing the current laws on birthright citizenship.
It my understanding that it is not part of US code, rather an interpretation of a random comment of a dissenting SCOTUS justice on another case.
