A BB gun is a firearm, the Minnesota Court of Appeals has ruled.
The court made its declaration in the case of a man who was not allowed to possess a firearm because of an earlier felony conviction for possession of a controlled substance.
This is the law that tripped up David Haywood.
Any person who has been convicted of a crime of violence, as defined in section 624.712, subdivision 5, and who ships, transports, possesses, or receives a firearm, commits a felony and may be sentenced to imprisonment for not more than 15 years or to payment of a fine of not more than $30,000, or both.
But the law doesn’t define what a firearm is.

my sympathy level for convicted felons that used violence and weapons in their crimes, that they lose their gun rights forever, is right there at zero and’i do not give a damn they can’t have guns anymore. they are lucky society did not execute them. train robbers were executed regardless if anyone was murdered. horse theives were executed for taking someones horse and leaving them stranded regardless they did not blatantly shoot someone. they are lucky to be alive.
Couldn’t a “felon” just rent a gun?
An air rifle is a variable pressure propelled by air or CO2 rifle. The air rifle is much more dangerous than a spring loaded BB gun but still is not a firearm. Either pressurized air or CO2 propels the BB in an air rifle.

i think its pretty clear felons have very little trouble getting guns.
I want one too! I have a Daisy 990 dual-power rifle, can use CO2 or pump it manually. The more I pump it beyond the regular 8 to 10 pumps gives me greater range. But no way would I get 350 yards! It can be deadly at close range if mishandled, I've put BBs through several boards and sheetrock which is thicker than my skull. But it ain't a firearm.
I don’t have a problem with violent criminals losing their 2A. Hell, I think they should do harsher sentences, but somehow, I’m just not all that concerned with Martha Stewart or Scooter Libby packing heat.
Once again, common sense proves an uncommon commodity in a liberal court.

In The People”s Republic of New Jersey a bb gun has firearm status as well as air soft.
Slingshots r illegal in NJ also.

One of the definitions for the intransitive verb “to fire” is:
to emit or let fly an object (Merriam-Webster)
Such dictionary definitions to do require any combustion for the verb to mean the propulsion of an object by whatever means. The method of propulsion with a BB gun may be either a spring or compressed air, which does in fact “let fly an object” as described in the definition.
Um, what? Holy mentally retarded leftists Batman! Simple logical question for the “smart” ones: Where is the fire, in a BB gun?

That’s wishful thinking. Any armament whose purpose is to “to emit or let fly an object” is defined by the dictionaries as the “firing” of an armament, whether or not any combustion is involved. You can fire a rock from a sling, catapult, or ballistae as they did in the ancient wars as a form of artillery.
