Attorneys for the Kentucky clerk who was jailed last week because of her refusal to issue marriage licenses to gay couples said Monday they have filed an emergency motion with a federal court that they hope will result in Kim Davis' freedom.
The filing seeks to have Kentucky Gov. Steve Beshear accommodate Davis' "religious conviction," and not compel her to grant licenses to gay couples, Liberty Counsel said in a statement.
"The motion requests an injunction pending appeal for an exemption from the Governor's mandate that all county clerks issue marriage licenses," said the statement by Liberty Counsel, which is representing Davis.
The same injunction request was denied last month by U.S. District Judge David Bunning, who jailed Davis on Thursday.
Charla Bansley, communications director for Liberty Counsel, said Davis could be released from jail immediately if the motion were granted by the U.S. Court of Appeals for the Sixth Circuit ordering Beshear to issue Davis an "accommodation" allowing her to remove her name and title from official marriage certificates issued in Rowan County.
By doing that, Davis would not be sanctioning any same-sex unions and her conscience would be satisfied, they say.
"If there was an accommodation, she would be released (from jail) because she would no longer be in contempt," Bansley said.

Bunning indicated Davis will be in jail at least a week. She could stay longer if she continues to not obey the judge's order. Bunning had offered to release Davis from jail if she promised not to interfere with her deputy clerks as they issued the licenses. But Davis refused.

Kentucky adopted a Constitutional Amendment defining marriage as one man & one woman. It was adopted with 75% vote.
Some of the people being turned away are from other counties and came for the purpose of being turned away.
She has been targeted.
> There is an option for her. She can step down from being the clerk and become a deputy clerk. She wont do this because she would lose prestige and a fine salary. This is where her Christianity would come into play. Will she choose money over Christ? Does she love money more than Christ?
She won’t step down because she would lose a “fine salary” “Does she love money more than Christ?” So, unless she resigns she loves money more than Christ? She’s in jail, that’s not enough?
She went to jail for the money?
Which option lines up with Christianity?
A) Being a clerk she gets paid more and has to sign illegal licenses.
B) Being a deputy clerk she gets paid less and has no connection with the illegal licenses.
She chose to the option go to jail. Why didn't she resign or ask to be a deptuy clerk?
The clerk and deputy clerks are bound by the same law.
It is an undermining of the foundation of natural law based government. It establishes precedent for deviations from the religious based principles which are necessary for the survival of our system of governance.
It opens the door for Polygamy, for pederasty, for bestiality, and for any other non-sane and vile practice for which there is no immediate appearance of a victim.
Yes, a crime is being committed. A Crime against Humanity. Same thing as the Nazis did, but just to a lesser degree.
For all we know, she may just not like gays and is using Christianity as an excuse.
Judeo-Christian religion states that Homosexuals should be killed, and we have three examples in the old testament of entire cities being destroyed because the inhabitants practiced and tolerated homosexuality.
The normal way of looking at homosexuals is to regard them as members of the "forces of darkness." Any objective examination of their past history in our society will confirm this characterization as accurate.
Most of our serial killers were homosexuals. Our worst spies have been homosexuals. 40% of our child molesters are homosexual. About 90% of the nations reservoir of vile nasty diseases such as herpes, chlamydia, gonorrhea syphilis, and AIDS are all kept active by that teensy 1.8% of our population. The Number one cause of death among Homosexuals is suicide. (Most people think it is AIDS) They are literally psychological nut-jobs allowed to roam free.
Not liking "gays" is what any rational person would do. Not granting them legal sanction is what any sane government would do.
That was uncalled for.
Is this what being a Christian is all about?
I thought we were having a civilized discussion.
I’m trying to understand and see different angles about this and you call me a troll? Don’t stop there. Ban me now.
Have a nice day.
As I mentioned, this stuff is far above my pay grade, but
Is there some rule that when a law is nullified that it has to have 2/3’s of congress voting to nullify AND 2/3’s of the states voting for it to be nullified?
The bottom line in this issue, as you’ve pointed out, is that
The supreme court basically gave an opinion that state marriage laws are unconstitutional when they ban gay marriage, the federal court steps in and has basically declared that all state marriage laws are illegal that ban gay marriage
Which in essence nullifies state marriage laws-
NO new marriage law has been issued by the state that forces clerks to issue gay marriage liscences
and therefore Kim has broken NO law
And besides all this, the federal government Has NO right regulating state marriage laws because marriage is NOT listed in the constitution.
This I believe is the defense that Kim’s lawyers is going to take after reading about the issue these last few days-
Kim has broken no law because Kentucky has NOT issued a law demanding clerks issue licenses to gays, AND the federal government has no business ordering states to do anything regarding marriage-
The interracial marriage ‘law’ that was enacted back In the 60’s shows that states do NOT have to comply with such orders- all the states did comply with that one- eventually- but some didn’t comply until 2000 some 30 years later- Not sure if county clerks were thrown in jail for not ‘complying with’ an illegal ‘federal laW’ back then or not?
Your comment is way over the top, especially when you make reference to Nazi atrocities. Let me ask you, if I’m working the check out counter at a local grocery store and I refuse to ring up ham because it is against my religion, are you going to be happy about it.
In other words, they are her religious convictions not mine. If your religion does not allow you to do a job, dont. Find another job. No conservative would hold any other position than that.
No, homosexuality is very much in line with Nazi atrocities, especially when you consider that most of the core Nazis were homosexual.
In both cases you have a denial of "natural law" to be replaced by "The law is what I have declared it to be."
That is how Nazism started. The first thing it did was to pass laws denying employment in government to Jews. This new faggot marriage law does exactly the same thing to Christians, albeit through the back door by forcing them to comply with a total, unlegislated change in law that is in complete contradiction with their faith.
It would be like passing a law requiring all government employes to eat pork. It would by default exclude Muslims and Jews from holding such an office.
In other words, they are her religious convictions not mine. If your religion does not allow you to do a job, dont. Find another job. No conservative would hold any other position than that.
Well first of all, the Nation's laws and History are DELIBERATELY BIASED towards the Christian religion. The US Constitution itself refers to Jesus at the end of it, and our laws have always been understood to be applied within the framework of a Christian people, so it isn't "her" religion, it is the NORMAL cultural position for all of this nation's existence.
Second of all, it is the DUTY of people to oppose immoral laws, not comply with them.
You object to me bringing the Nazis into this, but people obeying their immoral laws is exactly how they consolidated their power. Had the people stood up to them and said "I will not obey this immoral law", they would have been hard pressed to commit the atrocities that they later did.
And do not mistake it. This is the opening salvo in a war of cultural values that will eventually end with atrocities if the side of evil prevails.
Okay...so when you go into a market, don’t come to my checkout line if you are buying condoms or any meat products.
read a thread before commenting? now that’s a novel concept.
If you aren’t going to be serious in discussing a topic, you might warn people not to bother taking you seriously.
The comments in this thread or far from serious. If we think we can pick and choose in our job who we serve who we don’t what products so we can hand out, that we can choose not to hand out alcohol because it is against our religion, what products we can hand out of the checkout stand it just don’t work that way. Who doesn’t understand that is political insanity.
The law for the last several thousand years is that Homosexuals are sick perverts and need to be executed or locked up. When the country was created, they hung them for sodomy. Up until the 1960s, they arrested them if caught, and as often as not tossed them into asylums.
The Idea of giving them "marriage" certificates was not even a pimple on the anus of the butt of a fever swamp dream for the vast bulk of our history.
That idiocy is less than 20 years old.
I had no idea when you said you were serious that you wanted to go down the street to my neighbors house, drag them out in the street, gut them and rip their still beating hearts from their chests with your bare hands. What would you do after that, decapitate them and hold the heads up by the hair while you smiled posing for a picture?
