Jailed?
So a state or federal employee who refuses to perform job function X can be jailed, instead of simply fired?
In another article I read that she is an elected official, and therefore cannot be fired. She can however, resign.
She wasn't jailed for refusing to perform her job function, she was jailed for refusing a court order to perform her job function. And as an elected official she can't be fired. Only impeached or voted out of office.
Jailed?
So a state or federal employee who refuses to perform job function X can be jailed, instead of simply fired?
Here, let me try it: So a state or federal employee who refuses to report illegal aliens to ICE because they believe it to be immoral and declares the city they administrate to be a haven from federal immigration law can be jailed instead of simply fired? Hmmm...
She can be booted out by the voters at her next election...or, under Kentucky law, she can be impeached by her state legislature.
But "fired", no.

Dozens of N.C. magistrates refuse to perform gay marriages
RALEIGH, N.C. The number of North Carolina magistrates recusing themselves from performing civil marriages under a new law has more than doubled in recent weeks.
The state court system says it’s received 32 notices from magistrates since the law took effect June 11. That’s up from 14 in early July and represents nearly 5 percent of the state’s magistrates.
The law exempts court officials with sincerely held religious beliefs opposing gay marriage.
The law also gave the recusal option to some register of deeds workers issuing marriage licenses. Elected officials would perform the duties as a last resort.
She can’t be fired. She was elected and therefore must be impeached to be removed from her job.
From what I heard, if they did impeach her and she ran again she would be re-elected.
