In Kentucky a couple under 16, with a pregnant female, may marry with a judge’s permission and $5.00 payment. Ky. Rev. Stat. 402.020(1)(f)(3)

In New York marriage where either party is under the age of 14 is prohibited. N.Y. Dom. Rel. § 15-a

If two Kentucky 14 year olds, expecting a child, elope to New York they will not be able to marry. In NY any person issuing a license for such marriage “shall be guilty of a misdemeanor and on conviction thereof shall be fined in the sum of one hundred dollars.”

Surely this is discriminatory, a violation of equal protection, etc.

The Supreme Court said, “No union is more profound than marriage, for it embodies the highest ideals of love, fidelity, devotion, sacrifice, and family. In forming a marital union, two people become something greater than once they were. As some of the petitioners in these cases demonstrate, marriage embodies a love that may endure even past death. It would misunderstand these men and women to say they disrespect the idea of marriage. Their plea is that they do respect it, respect it so deeply that they seek to find its fulfillment for themselves. Their hope is not to be condemned to live in loneliness, excluded from one of civilization’s oldest institutions. They ask for equal dignity in the eyes of the law. The Constitution grants them that right.”

Why should these 14 year olds be denied the respect of marriage? Why are they denied equal dignity?

Since the Supreme Court has arrogated to themselves the power to legislate, the power to commandeer State legislatures, why haven’t they provided a uniform marriage code for the entire United States? Why are they disrespecting the idea of marriage, “the highest ideals of love and devotion”?

Yes it is. And for the arseholes here on FR who say she should just issue the licenses or quit her job, let me remind you that RELIGIOUS FREEDOM has no limits in the Constitution.

Nowhere in the Constitution or any Amendments does it say that one is not permitted to live out their faith simply because the government says so, or they hold a government job.

NOWHERE.

Various pols are weighing in and defending Davis with a religious freedom argument. This argument is doomed to failure. It is better to confront the illegitimate actions of the USSC.

Having government employees freelancing on policy rather than following the law would be a Pandora’s Box that would let meddling socialist bureaucrats run even wilder than they already are.

You miss the facts. Kim Davis was not arrested for violating a law, she was arrested for disobeying a judge. IF such a law were on the books there would have been no need for the judicial theatrics thus far.

Last time I checked, judges don't write laws and states trump the fed regarding marriage jurisdiction.

Kim Davis was upholding the laws of the State of Kentucky, the only jurisdiction that exists in this matter.

That's the way I see it. Picking on some lowly clerk is intimidation of the people when the Feds should be addressing these issues with the state's legislature.

Try disobeying a judge and see what happens to you... it won’t go any different for you.

It’s not because of a law written by any court, it’s because of a law passed by Congress, specifically 18 U.S.C. §401 (1964), the federal contempt statute.

As far as 9th/10th Amendment jurisdiction is concerned, I wholly agree. But if those Amendments are suddenly in force again, 90% of the federal government has to be unwound - and the sad truth is that 90% of this country doesn’t want that to happen.

Another ping to you guys who think the 14th amendment was such a great idea.

The First Amendment expressly limits only the power of Congress. Do we need the 14th Amendment to protect us from states that might want to deny you any freedom of speech, religion, etc? There might be some good with the bad here.
