Just tell the Judge to go pound sand, since when does one separate but equal branch of government have the power to TELL another separate but equal branch of government how to run their separate but equal branch of government?
Actually, under Article III of the Constitution, the judiciary is pretty much limited to what Congress allows it to do.
Only the Supreme Court is specifically created by the Constitution. All lower courts exist "only as the Congress may from time to time ordain and establish." The Supreme Court's appellate jurisdiction is expressly subject to "such exceptions, and under such regulations as the Congress shall make."
Unfortunately, Congress has completely rolled over and allowed the Supreme Court to become an oligarchy of judicial dictators.
