Jurist ignores physicians, orders more counseling for Dinesh

Conservative scribe Dinesh D’Souza has to perform a lot more community service for breaking campaign-finance laws than he thought, with a federal judge saying Monday that D’Souza has to do eight hours each week for the entire five years he’s on probation and not just the eight months he was confined to a halfway house. The judge also read aloud a report from a court-appointed psychologist who calledD’Souza “arrogant”and “intolerant of others’ feelings.”

Powerhouse defense attorney Ben Brafman was surprised when Manhattan federal court Judge Richard Berman clarified the sentence he handed down after D’Souza pleaded guilty last year, which means D’Souza will have to do over 1,600 hours more service than he initially thought. “We’re talking about five years of eight hours a week? … This is a very serious impediment to obtaining full-time employment because you miss one day of work a week,” Brafman said in the conference inside Berman’s robing room, as D’Souza listened in silently via speakerphone.

“In my mind it was never contemplated that the eight hours only applied to the period of home confinement,” Berman said, later reading out a report from a psychologist who saw D’Souza and then ordering him to continue attending weekly sessions. “The client tends to deny problems and isn’t very introspective,” the psychiatrist wrote. “The client tends to deny problems and is arrogant and intolerant of others’ feelings.”

D’Souza — the maker of the anti-President Obama film “2016: Obama’s America” — did hear some good news during the proceeding. So long as D’Souza stays on track with his community service, he will be allowed to visit his daughter in London and his elderly mom in India later this year, Berman said.

D’Souza pleaded guilty last year to illegally shelling out $20,000 in contributions in the name of others for Republican Wendy Long’s failed 2012 bid to defeat Sen. Kirsten Gillibrand (D-NY).

Brafman waived D’Souza’s appearance at the conference as he lives in California.

True, but the underlying basis of that belief lies in how Liberals are driven by emotion while tend to be driven by logic and reason.

Isn’t that exactly what the judge is saying here? That because D’Sousa isn’t emotional enough (ie insensitive to feelings of others) he needs to be MADE to be more emotion-driven.

Yes, Justice Kennedy said exactly that.

I wonder tho, if D’Sousa were to claim that his appearance of “lack of sensitivity” is cultural in nature, he might have one heckof an ethical bias claim against that judge. Perhaps enough to get him disbarred.

Oh, wait, this is the NY bar we’re talking about.
