Ted Cruz has some unsolicited advice for the states not specifically named in last weeks Supreme Court ruling on gay marriage: Ignore it.
Those who are not parties to the suit are not bound by it, the Texas Republican told NPR News Steve Inskeep in an interview published on Monday. Since only suits against the states of Ohio, Tennessee, Michigan and Kentucky were specifically considered in the Supreme Courts Obergefell v. Hodges decision, which was handed down last Friday, Cruz a former Supreme Court clerk believes that other states with gay marriage bans need not comply, absent a judicial order.
[O]n a great many issues, others have largely acquiesced, even if they were not parties to the case, the 2016 presidential contender added, but theres no legal obligation to acquiesce to anything other than a court judgement.
While Cruzs statement may be technically true, federal district and circuit courts are obligated to follow the Supreme Courts precedent and overrule all other states same-sex marriage bans as unconstitutional.
The Texas senator then went on to suggest that Republicans who have called for following the courts decision are members of a Washington cartel and are lying when they say they do not support same-sex marriage.
[Republican Party leaders] agree with the rulings from last week, both the Obamacare ruling and the marriage ruling, Cruz said. [T]he biggest divide we have politically is not between Republicans and Democrats. Its between career politicians in both parties and the American people.

Constitutionally speaking, he is correct.
States have a duty to ignore laws that are unconstitutional. In order to protect their citizens.
Ted is saying that the ruling of the USSC was binding on the parties of the case and that each state and other parties can take up the banner and fight again and again and again. He’s saying it’s a lost battle not a lost war.
And legally he’s right about the ruling applying only to the parties of the case. Other parties can ignore the ruling and file a lawsuit, each time trying different strategies and tactics.

Interestingly enough, the white house effectively said they would ignore today’s ruling on the EPA.

The liberals do this with the right to keep and bear arms. Just make the license difficult, conditional, and so forth. Litigate, litigate, litigate.

Heard on O’Reilly a few minutes ago that Obama lit up the Black House in celebration of the queer “.marriage” victory. Of course Juan Williams said it’s perfectly fine......then “conservative” Mary Katherine Ham got her points in but not before she said she was a “supporter of marriage equality”. The Fox News airheads have almost universally fallen in oline in their “support” of fag “marriage”. All the talking mini-shirts on The Five and Meghan Kelly are all but giggling their support. Makes me want to throw up. Charles Krauthammer, although he thinks states should decide, agrees with it also. Says it’s a queer’s “constitutional right”. He’s also pro-abortion. Bernie Goldberg is also for queer “marriage” and abortion.
Politico makes it sound like Cruz was a mere legal assistant.
He has taken cases before the Supreme Court and has won. Big difference.
In other words - he knows what the hell he is talking about.

Both you and Ted are correct. Why governors and legislatures accept with no fight rulings from the SCOTUS that are so flat out wrong and beyond the scope of their authority is beyond me.
Ted Cruz is spot on, here.
And this is what I needed to see from the gaggle of GOP’ers wanting the nomination:
Don’t tell me what you you’ve done (I can look it up myself)
Don’t tell me what you are going to do (We’ve heard it all before)
Tell us we you are doing, and what we can do NOW!
The one who does that - gets my vote
P.S. Mind you, I doubt we may even get a chance to cast a vote for another president, but that’s another matter.
The supreme court ruled that they can’t impose sweeping regulations without taking cost into account. There were a whole crapload of power plants that were going to be forced to shut down soon.
Something like 9 of them are here in Michigan which is why we were a primary plaintiff out of 22 states.
Have to admire Ted for sticking to his principles. Bet this is a stake through the heart of his chance for the oval office though.
