Congress could fix this by simply passing a law stating that no issue on the constitutionality of any state or federal law may be heard by any court other than the Supreme Court and that the Supreme Court cannot overturn any state or federal statute on constitutional grounds unless 7 of the 9 justices concur.
Congress has the power to reign in the courts. They just won’t use it. Most likely because they really don’t want to have to deal with these issues themselves. The Supreme Court gives these weasels cover.
First of all, Congress does not have to pass a law. The words in Article III are, "with such exceptions, and under such regulations as the Congress shall make". Regulations and exceptions AS THE CONGRESS SHALL MAKE, not "pursuant to law".
Congress' power here is plenary, it does not require a Presidential signature, and a Presidential veto is not permitted.
Secondly, I'm sure you are right that Congress lacks the balls to do this.
But, if it were to be done, I would favor a narrow regulation barring appeals pertaining to State marriage laws, at least at first.
And why are they afraid to do this? We all know why. They know the Monopoly controlled Liberal Propaganda machine will shift into overdrive and start attacking them 24-7 on all propaganda channels.
The Dire threat we face in this nation is the loss of freedom of speech for conservatives. Our message is never allowed to reach the public because all the means to do so are in the control of Left wing forces.
We should have been demanding that congress smash this system. We should be suing these corporations for deliberate discrimination. We should be accosting the people that work in these industries and demand they tell the truth.
The Lynch Pin of all the disasters we have been facing for several decades is LIBERAL CONTROL OF TELEVISION/MOVIES/PUBLISHING/INTERNET.
The Propaganda machine is why congress won't touch this.
Who has the power to say how many 'justices' sit on the Supreme Court?
I have been saying that for thirty years, but an ignorant voter cares not.
You are correct. I am getting pretty sick and tired of all of these stories going after the supremes and their decisions. Congress has the power if they want to us it but they won’t b/c the supremes give them cover.
“Congress could fix this by simply passing a law stating that no issue on the constitutionality of any state or federal law may be heard by any court other than the Supreme Court and that the Supreme Court cannot overturn any state or federal statute on constitutional grounds unless 7 of the 9 justices concur.”
That would have prevented the Supreme Court from striking down a local law prohibiting the ownership of handguns (5-4) and the Citizens United case (also a 5-4 decision).
Obama would veto. There will be very little push back. Those with the most to lose are on our side and will delay reacting for personal reasons. A few that do react will be labelled extremists as they are dispatched.
Congress has long abdicated their responsibilities to the Executive. They now exist to exist and suck up K-Street Buck$.
