The End of Democracy Continues

Millions of Americans (or thousands of journalists, wonks, and wags) are sitting on pins and needles right now, waiting for the Court’s determination: Will the world’s only superpower decree that same-sex marriage is a constitutional right? Other decrees came down this week—ranging from lawn-signs to Spider-man to Obamacare—that merely whetted the appetite of the twenty-four hour news cycle.

Almost twenty years ago, First Things published a series of essays documenting the decline of the democratic process. Robert Bork bemoaned the oligarchy of the judiciary. Hadley Arkes felt the tremors of the same-sex marriage movement before it picked up popular steam. Robert George observed that judicial interpretation of the Constitution had gone beyond the idea of the common good and the natural law, thus calling into question the American democratic project.

The primary difference two decades later is not one of substance but of acceleration. The problems of the 90s are greater today than ever. What then can we say as we nervously await the decision of the Supreme Court on these central issues? In many ways, it doesn’t matter what the ultimate outcomes of the decisions are. The very fact that crucial decisions between camps with diametrically opposed views of central debates are being determined by the Supreme Court reveals that our representational democracy has suffered a critical wound.

The United States of America was established as a nation of laws, undergirded by the framework of the Constitution. The citizens of this country are endowed with the freedom and responsibility to vote for representatives who write and vote on laws. Every generation in America has had fundamental questions about government and rights, and the genius of our system is a peaceful mechanism to deal with them as they arise.

Today, though, instead of attempting to persuade one’s fellow citizen, activists of all stripes are circumventing the democratic republic—the fundamental structure of this country—and are trying their luck with the Supreme Legislators. This “judicialocracy” fails to satisfy either side. It leaves the losing party feeling like they have no more options besides interminable legal fights. Whereas unpopular decisions from the legislative and executive branches are answerable to public elections every few years, there is no realistic recourse for countering the Supreme Court.

A common theme developed in the essays in the End of Democracy symposium: Either the situation of the judicial takeover of democracy must be radically reformed, or conscientious objectors must learn how to disobey the new system peacefully, recognizing that democracy had been replaced by despotism.

No sense sitting on pins and needles.........let me help you. SCOTUS will rule for the LGBT crowd. I made this prediction here before today's ruling and I still stand by it. None the less, I'll pray for the unexpected (ruling against SSM).

The corrupt, stupid, and incompetent Republican party led by the corrupt GOPe has brought this upon the country. We had the chance to shut down Obamacare (and amnesty) in Congress, but the GOPe powers that decided to kneecap Ted Cruz.

To He** with the Republican party and its GOPe masters. It is high time for a true conservative movement.

We lovers of freedom and rule of law are getting our asses kicked by fools who say "But resist, we MUCH – we must and we will much about that be committed." How pathetic is THAT?

This has me very nervous. There have been plenty of divine shots across the bow (mostly of a climactic nature) over the past 6 months. I fear that all you-know-what will literally break loose if SCOTUS forces same-sex “marriage” on the United States. Stock plenty of batteries and bottled water just in case. And check your sump pumps. Make sure they work. Not sure this will help if you live on a fault line or near a caldera, though.

N.B. A note to any new, emerging nation. Do not, under any circumstance, adopt the concept of judicial review of regional or central government legislation by a high court. It will come back to bite you, for sure.

You’re right. I have been concerned for years about this very moment. Why? Because, for the uneducated and distracted hoi polloi, they think that once something is LEGAL, it makes it MORAL. When this is the case, when the masses believe this, they are making government their god. They are allowing the government to be the superior form of authority. Humanism and post-modernism is the new rule of order and there is nothing that can derail it. The only good news? This is all foretold and designed. Now, we just have to ride it all out.

So if it does indeed happen, what happens to people who express the fist amendment right and speak out against it. Will the government make it illegal to be critical of the lifestyle? After all, it is a “right.”

Whats happened is the demise of "the REPUBLIC".. replaced by a democracy...
A heinous criminal offense.. not only sedition but espionage.. advancing to treason..

Benjamin Franklin said we have given you a Republic if you can hold on to it. In the midst of the financial ruin, the corruption of our leaders, the endemic voter fraud and the worldwide destruction of the faith in America, we are nearly done. The open abuse of the press has violated the very foundation of Freedom of the Press and is nothing more than a propaganda machine geared towards abject (socialism) for this country.

I have always been a person who has looked at the glass as being half full, I have taken heart in our small victory’s of revealing political malfeasance in office only to see them remain in power. I have seen the people we have elected and believed in, go to Washington and become nothing more than washed out shell of why we elected them.. I have been naive in believing that our country would always be on the side of right and our that our Constitution would never be abridged. I, naively, believed that if we were on the edge of destruction, true patriots would emerge and fight back and save our nation. I have seen none, they are not there, all we have are politicians with their main goal is self, clutching to their power as a child would of his security blanket.

The final nail has been driven into the heart of our Republic when the our Congress, who swore to protect our Constitution, , bowing down on their knees to the alter of (socialism). They have ripped apart the very essence of the Constitution and rendered it just ancient paper with words of Patriots with hopes and dreams for our Republic. We have betrayed their trust, we have stood by silently and watched the incremental destruction of our country and put our future in the hands of the spineless, the power hungry, the undeserving and the corrupt.

WADR....In regard to the headline; If our Country had remained a Constitutional Republic as it was founded we would not be experiencing the shameful, rotting decline into which we are now rapidly sliding.

Upon the completion of our Founding Documents, when asked by a woman on the streets of Philadelphia as to what kind of government the Founders has given us, Benjamin Franklin replied, “A Constitutional Republic....if you can keep it.” We obviously have let it slip away.
