Nixon went wrong by using the Fairness Doctrine against his media enemies ranging from Conservative radio preacher Dr. Carl McIntire who advocated military victory in Vietnam to NBC News over a pension documentary.

I was a regular listener to Dr. Carl McIntire back in the 60s and well remember "Amen Charlie". McIntire's "Twentieth-Century Reformation Hour" was always solid in its attacks on communism and alerting listeners to the disruptive spread of liberalism in the Republic.

I believe the liberal media and all media are protected by the First Amendment.

Here I respectfully differ. As far as I know, seditious treason isn't encompassed by the 1A. If I'm correct in my analysis, then indeed outlets such as CNN and MSNBC aren't afforded such protection. At least that's my take colored by watching the leftist media ruin America over the past 70+ years of my life.

CNN and MSNBC commentators, Fox commentators and so on offer opinion and put on a show to suck in liberals, conservatives and so on into being angry over the issues.

If we shut them down, we would have to shut everyone down.

CARL MCINTIRE SUPPORTED EVERYONE’S FREE SPEECH TO THE POINT OF INVITING JANE FONDA (A ‘TRAITOR’ MANY WOULD SAY) TO HIS MICROPHONE ON AN OFFSHORE “PIRATE” RADIO STATION HE SET UP AND BROADCAST FROM FOR TEN HOURS.....

AND HE ALWAYS SAID, PART OF ITS IN MY TAGLINE: ‘FREEDOM IS EVERYBODY’S BUSINESS, YOUR BUSINESS, MY BUSINESS, THE CHURCH’S BUSINESS AND IF A MAN WILL NOT USE HIS FREEDOM TO DEFEND HIS FREEDOM, HE DOES NOT DESERVE HIS FREEDOM’.

I concur with your observation, with one very slight exception and an addition: The constitutional definition of treason is that Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

Accordingly, it is NOT the Constitution which creates the crime, but only defines it, leaving it to congress to create the law and appropriate punishment: The first Constitutional paragraph of Article III Section 3 permits Congress to create the offense, and restricts any punishment for treason to only the convicted, the second paragraph. The crime is prohibited by legislation passed by Congress. Therefore, the United States Code at 18 U.S.C. § 2381 states "whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States."

That leaves the question as to whether the *liberal media and all media* owe allegiance to the United States; if not, they should then forfeit any claimed rights under the First Amendment, and if so, should be subject to the provisions of Article III Section 3.

The other constitutional point: Under the Fifth Amendment No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger.... Of course, rioting; insurrection and any attempted overthrow of the constitution by those in government would certainly constitute *public danger,* as does an invasion of this country by literally millions of foreign nationals unlawfully present. It remains only for the land or naval forces, or the Militia, to do their duty and deal with such treason.
