Obama's Secret Court for Killing
Creators.com ^ | June 2015 | Judge Napolitano>

Posted on 06/09/2015 9:47:43 AM PDT by yoe

President Obama willingly admits he dispatched CIA agents to kill an American and his teenage son and the son's American friend while they were in a desert in Yemen in 2011. He says he did so because the adult had encouraged folks to wage war on the United States and the children were just "collateral damage." He says further that he'll do this again when he is convinced that killing Americans will keep America safe. He says he knows the adult encouraged evil, and his encouragement caused the deaths of innocents. The adult was never charged with a crime or indicted by a grand jury; he was just targeted for death by the president himself and executed by a CIA drone.

International law and the law of war, to both of which the U.S. is bound by treaty, as well as federal law and the Judeo-Christian values that underlie the Declaration of Independence (which guarantees the right to live) and the Constitution (which permits governmental interference with that right only after a congressional declaration of war or individual due process) all provide that the certainty of the identity of a human target, the sincerity of the wish for his death, the perception of his guilt and imminent danger are insufficient to justify the government's use of lethal force against him. The president may only lawfully kill after due process, in self-defense or under a declaration of war.(emphasis mine)

The reasons for the constitutional requirement of a congress............

An American Citizen who goes abroad and sides with the enemy loses all Constitutional rights.

I am OK with killing all enemy combatants.

“I am OK with killing all enemy combatants.”

There is a HUGE difference between killing an American as an enemy combatant on the battlefield, and a President SPECIFICALLY targeting an American Citizen for death, without a constitutional trial.

Obama has crossed that line.
If anyone in D.C. had the stones to stand up to Obama, THIS would be the thing that would put Obama in an Orange Prison Jumpsuit.

Just imagine the endless 24/7 hate media barrage and endless hand-wringing we’d be subjected to is a REPUBLICAN had done this?

We have a process for that in the Constitution. You do remember the Constitution, right?

The Three Pharoahs:

Boehner and McConnell support the White Mosque
because they covet the power to kill, to tax, and
remain EXEMPT above all others.

Yeah, I just can’t get worked up either over greasing these “Americans” who go and fight for Al Qaeda/ISIS. Good riddance.

"“I am OK with killing all enemy combatants.”....and emotionally who isn't...however, Constitutional Law requires Congress to declare war before anyone can do what otherwise we become lawless like BHO, who likes hiding behind drones, his weapon of choice along with his lies....a true coward never can accept or acknowledge who he/she is...they always blame someone else and hide behind, in this case, computer driven death i.e., Obama's drones.

“....he’ll do this again when he is convinced that killing Americans will keep America safe.”

Which America is the Current Regime concerned with in “keeping safe”?

The Current Occupant has a different version of “America” than either you or myself may have. In the Current Occupant’s eyes, a threat to “his” America may very well come from internal sources, and it is not much of a stretch at all to determine that there is “justification” for a drone attack on a vehicle traveling on I-80 believed to be carrying a “patriot” intent of reversing some injustice in the territory, and that this “secret court” gives him the supposed authority.

Does the term “Star Chamber” mean anything? In medieval England, the king convened a secret court of inquisitorial and criminal jurisdiction that sat without a jury and that became noted for its arbitrary methods and severe punishments. It was abolished in 1641, but it seems to be revived by the Current Regime.

We already knows he ignores the Constitution and throws tantrums. Yesterday it was those three in the desert but tomorrow it might be a white privileged mom driving an SUV full of kids to a soccer practice.

I bet you are also ok with the Japanese internment camps, no knock warrants, NSA data collection, or any of the other govt over reaches, just as long as you feel “safe”. Screw it we don’t need the constitution anymore.

So a non-citizen can obtain full American civil rights by illegally gaining entry to our country and an American citizen loses all of his (and his children’s) civil rights when he leaves our border?

So the rights of citizenship are strictly granted by geography? But our tax system taxes a citizen’s worldwide income no matter where he is?

That makes perfect logical sense in 0bama’s insane mind.

“I am OK with killing all enemy combatants.”

So was King George III. Luckily for Thomas Jefferson, George Washington, John Adams, James Madison, Alexander Hamilton and other founding fathers they won the Revolution and were not hanged as traitors for collaborating with the French in waging war against England.

“and it is not much of a stretch at all to determine that there is “justification” for a drone attack on a vehicle traveling on I-80”

IF that is not much of a stretch, then what stops him from doing it? He could easily find his most outspoken enemies and take them out if he wanted.
What is stopping him?

So in your example the Jefferson, Washington or Adams is the traitor who sides with Islam.
I believe our president stinks on ice, but this article feels like a hit piece, written to divide.

“Yeah, I just can’t get worked up either over greasing these “Americans” who go and fight for Al Qaeda/ISIS.”

Yet, Awlaki didn’t fight for Al Qaeda or ISIS. The man was a writer, an academic. Yes, he was a terrorist sympathizer and wrote stuff that they used to justify their actions, but calling him a “combatant” is just laughable.

“So in your example the Jefferson, Washington or Adams is the traitor who sides with Islam.”

To the British of the 1700’s, France was a greater enemy than Islam is to the US today. Hence, the founders were traitors of the worst kind.

It may be those who fight with Islamists in the Middle East are traitors to the US. However, I would not condone allowing the US President to order the death of any American citizen without due process of law. The history of tyranny demonstrates that once government acquires a power it works to extend the power, particularly when leftists are in charge. Today it is drone strikes against Americans in Yemen. One day it may be average citizens who dare to disagree with the the nation’s leader.

Great nations uphold core values, ideals, and laws when it is difficult to do so. Tyrannical nations kill citizens without due process, appropriate property without due process and just compensation, conduct searches and seizures of citizens without warrants, suppress free speech and religions expression, unevenly enforce the law, and work tirelessly to disarm the population. Unfortunately the American government today behaves more as a tyranny than as a beacon of liberty.

“What is stopping him?”

At the moment, the Current Occupant still cannot believe his extreme good fortune that nobody has called him on the rogue malfeasance of the powers of the White Hut, and he is trying to screw up the courage to take the next step.

It isn’t like Valerie Jarrett hasn’t been pressuring.

But at heart, the Current Occupant is kind of a wimp.
