Prosecutor details ‘executions’ at Twin Peaks during hearing

Video of the deadly May 17 Twin Peaks shootout between rival biker gangs shows “Bandidos executing Cossacks and Cossacks executing Bandidos,” a prosecutor said Friday at a bond-reduction hearing for a Cossack from Northeast Texas.

The revelations from First Assistant District Attorney Michael Jarrett during Laurance Kemp’s bond-reduction hearing were among the first detailed glimpses provided by authorities of what occurred during the incident that left nine bikers dead, 18 wounded and 177 arrested.

In arguing against reducing Kemp’s bond to an amount that would allow him to be released, Jarrett said Kemp traveled 3 1/2 hours from his home in Bogata in Red River County that Sunday morning, proudly wore his Cossacks colors and associates himself with a group law enforcement considers a “criminal outlaw gang.”

After hearing testimony from the 40-year-old Kemp’s fiancee and her mother, 54th State District Judge Matt Johnson reduced Kemp’s $1 million bond to $250,000. His family said after the hearing that they would not be able to raise the money to secure his release.

Jarrett said video from the incident showed a group of Cossacks arriving at Twin Peaks and “spreading out across the patio in sentry positions,” obviously keeping close watch on their surroundings.

Later, video shows Cossacks looking in their vests and checking their holsters for weapons, Jarrett said. As a line of Bandidos rode through the parking lot, Cossacks scramble over patio railings as the shootout ensues, Jarrett said.

“The video clearly shows Bandidos executing Cossacks and Cossacks executing Bandidos, some at point-blank range,” Jarrett said. “The facts and circumstances of this case are so extraordinary and so different from anything we have ever dealt with, we believe adequate bonds need to be in place to ensure the safety of this community.”

Kemp’s attorney, Lawrence Johnson, argued that there is no evidence that Kemp did anything wrong that day and he shouldn’t be held on excessive bond just because of his biker affiliation.

Kemp’s fiancee, Julie Harrison, the mother of his 20-month-old twins, said one of the twins is disabled and that Kemp, who works for a road construction company, is the family’s sole breadwinner.

She said her 95-year-old grandmother has offered to help pay a portion of Kemp’s bond, but said $2,500 would be the maximum amount her family could raise.

The family would have to pay $25,000, or 10 percent, to make Kemp’s new bond.

Wiping away tears after the hearing, Harrison said her son has brain cysts that cause seizures and the family needs Kemp at home. With Kemp in jail, her family is suffering financial hardships, she said.

Harrison testified that the Cossacks group Kemp is associated with are good people who raise money for charities and who helped her family when their twins were born prematurely.

In other developments in the bikers’ cases Friday, two attorneys have petitioned the Texas Court of Criminal Appeals in Austin on behalf of 144 bikers, seeking a “prompt and efficient administration of justice.”

The petition asks the court to order Judge Billy Ray Stubblefield, the regional administrative judge, to assign visiting judges to McLennan County to conduct immediate bond hearings for the bikers still in jail.

Prosecutors and defense attorneys for the bikers have negotiated lower bonds in about 70 cases, with about 53 of the 177 bikers being released after negotiating reduced bonds.

There were other bond reduction hearings set for Friday, but they were canceled after negotiated reductions.

More bond hearings are set for every Friday in June and several in July.

1. We are talking convictions not arrests.

2. No, I don't believe every gang member has a record, but I also don't believe that in a real criminal gang 2/3 of the members don't have records.

3. As far as the Cossacks "posting sentries", every officer and deputy is trained in "situational awareness" and recommends this to the public in dangerous places. But here it becomes evidence of criminal intent.

4. Later, video shows Cossacks looking in their vests and checking their holsters for weapons, Jarrett said. If I look in my vest to see if my underwear is sticking out, is that criminal?

All in all, it is impossible to justify the number of police rounds fired, and refusal to release the videos is suspicious at best.

According to FR all of these bikers are Eagle Scouts and unarmed? Only the cops are the bad guys oppressing the innocent bikers.

My guess is the killing was done by the bikers, but we shall see.

...

I’m going to wait for this to get all sorted out. But there are some here on FR who take any negative accusation against the police to be the absolute truth.

Your tagline whould indicate that you should be interested in the other aspect of this story - beyond police action; that being the matter of mass arrests, excessive bonds on overcharges, probable cause, etc.

There should be greater outrage at actual criminal charges, rather than general warrants, directed at the criminal gangs.

What, really, is the purpose of "outrage"?

One thing is clear, there is a good deal of interest here at FreeRepublic in this story. I was shocked to see one thread went nearly 400 posts the other day. These threads attract trolls like honey, too. Yet, no mention in the MSM, nutin’ on Fox news. Crickets. I don’t get it.

The only way the video taints the jury pool is that the video is held inadmissible at trial.

The fact of million dollar bail and similar implication (person is too dangerous to release, for example) also taints the jury pool in the government's favor.

There is plenty of outrage at criminal gangs. When this nation gets to the point that outlaw bikers are our biggest problem we will be dang near utopia. While we are putting resources and lives into biker gangs we got much bigger problems we are doing nothing about. You and others accuse me of being on the side of the outlaw bikers. I got news for you. I have done something I bet you never have. To their face I have threatened to shoot several for what they had done and a man with a temper would have. Of course they were just heavily tattooed wannabes so I live to tell the story. Also, they knew that I was right about it and apologized profusely.

There were 9 people killed, 1 was a member of the Bandidos. More people were injured (gunfire? knifings?) but I didn’t hear details or affliations.

So there may be video of Cossacks ATTEMPTING to execute Bandidos or there may be video of Cossacks executing A Bandido, but there is NOT video that clearly shows Cossacks executing Bandidos.

It’s like the 9-11 case where reports said that the hijackers were observed playing a Golden Tee pinball machine at a strip joint. Golden Tee is a video game, not a pinball machine. Words mean things. The DA is erroneous.t hear details or affliations.

There has been no report of how many have criminal records.

By the way the LAST thread from any of the biker gang apologists was at 0700. You all riding and protestin today in Waco? Bet not. Likely hiding in shame. Or maybe better yet, FR got a craw full of THUG OUTLAW BIKE GANG supporters.

The Cossacks didn’t care about the safety of the “clean” bikers. They are probably not shedding any tears over their arrests.

I hear that. Based upon a variety of (what later turned out to be demonstrated) falsehoods that have come out of police (and DA?) sources, I’m not going to “suspend disbelief” of the statists’ pronouncements until such time as incontrovertible supporting material (all videos, autopsy reports, forensic reports including medical reports on the wounded, ballistic reports, etc.) items are released. As it stands, all government entities (e.g., Obama’s on-site DOJ/BATF elements, Waco police SWAT team) involved in this are sitting on ALL factual material so tight they likely have all developed very bad hemorrhoids. Everything about this travesty does NOT pass my smell test and the smell grows more rank as time goes on.

Although dozens of those arrested do have criminal records, 117 did not have any convictions listed under their names and birthdates in a database maintained by the Texas Department of Public Safety.
