Attorneys: Waco shooting detainees could be legal liability

Defense attorneys representing many of those jailed for the Twin Peaks shooting in Waco said law enforcement officials in McLennan County are overseeing an unprecedented and unlawful mass arrest of innocent bikers as more were released Monday at the behest of their attorneys.

Killeen residents Justin Nash Waddington, Ester Sandy Weaver, Walter Thomas Weaver and Zebulon Harris; Colter Bajovich and Ronald Atterbury, both of Gatesville; Daryle Walker of Harker Heights and Glenn Walker of Copperas Cove are among those in the McLennan County Jail on charges of engaging in organized crime. Each is being held on a $1 million bond.

“That was an immediate red flag,” said Josh Tetens, a defense attorney in Waco representing Roy Covey, speaking of the initial arrest of almost 200 bikers. “I think Judge Peterson said it well when he said that his sole reason for setting million-dollar bonds against so many people under the exact same charge was to ‘send a message,’ which I believe in and of itself is completely unconstitutional.”

Defense attorneys said the mass jailing of defendants has exposed McLennan County to expensive lawsuits.

Sounds like you object to people photographing police at all to be a problem.

IMO, that officer should conduct himself in a manner that he is proud to be recorded doing his job.

When officers are not doing so, they deserve what they get, even if it is the dreaded “red circle.”

Do you have any sense for how foolish you sound?

So far, reviewing a half-dozen threads on this topic, I count only 18 FReepers who are buying the official LEO line RE the Waco 170, versus 46 who smell a big crap-filled rat. As for FReepers who are on the fence waiting to learn more, an educated guess is 20 (if the poster doesn't make the stance clear one way or the other, I don't include him/her in my count at all). Counting individual voices is the ONLY way to get an accurate picture of FReeper sentiment, because the 18 post prodigiously, creating the impression that they are much larger in numbers than they actually are. In reality, their numbers are few, though their comments are many.

Threads like these provide insight into which FReepers are fakes, and which are real.

LOL! I saw a whole bunch of those that didn’t smell a rat and ranted all day about the prisoners having to sign a waiver to get out of jail!

Turns out the waiver was invented by some skunk lawyer that is now being turned into the state bar association.

It is sad that many who saw the first accusation from attorney Looney, might not have seen his complete retraction a day later. That the DA had nothing to do with it.

The retraction did not get the same FR attention as the original accusation by a long shot.

Mac_truck said it seemed like lawyer histrionics on the original post. Seems he was right.

But truth loving FReepers can be counted upon to dig out that information. No need to spoon feed FReepers with the truth . . . they are all over it.

Mac, Kudos to you. I admit that when the post accusing the DA of collaboration with the “sign and go free” supposed agreement came out, I was very sickened, and agreed with don-o, that if this were the case, it was a bad day for the County, and neither of us took pleasure in that.

Still, your instinct and courage led you to counter the accepted story. Thank you very much, for having the moral courage to post what you did, in the face of contrary opinion.

I have never dismissed your comments. In fact, I read and consider all posts. I submit, however, that what you post should be read and considered as carefully from now on as what don-o, for example, posts. You got the Truth on this case, and please more to come.

I saw some speculation that the DA might have actually made a verbal quid pro quo offer. If he did, that was a dumb move. If he did not, then why did the woman who is accused of claiming he did, do what she maybe did? Bottom line - SOMEONE put it out there.

Regardless of who did what, bonds are being lowered without waivers. And that is a good thing, though way past overdue and not excusing or compensating for the trampling of probable cause and due process.

Yes it is.

I have spent a good part of the day looking at the jail report linked in one of today’s threads.

What do you take of the fact that some ~40 of the ~126 are charged with engaging in organized criminal activity, felony to the first degree, and the rest of them are not charged with the first degree? Do not know just asking.
