Maddow Blasts Law Requiring Aurora Shooting Victim's Parents To Pay Gun Manufacturers

Maddow opened her show with heart-rending footage of the Aurora trial. She highlighted the testimony of Brenton Lowak, whose friend Jessica Ghawi -- a 24-year-old aspiring sports reporter -- died in the shooting.

The parents unsuccessfully sued the retailers who made the firearm that killed their daughter. Colorado state law requires that plaintiffs who sue the manufacturers of gun products pay the companies' legal fees if they lose.

“That’s not a typo,” Maddow said, adding, “The mother and father of the victim who died in the Aurora mass shooting have just been ordered to pay a quarter-million dollars to the gun makers who sold the bullets that were used in the Aurora mass shooting -- the parents of the girl who was killed.”

This is GOOD news. Loser pays, if adopted nationally, will greatly increase the productivity of the economy and allow folks and companies to focus on their actual products and services. The parasite lawyers who file millions of frivolous lawsuits will have to find new scams (or perhaps unexpectedly start being productive members of society).

I believe that’s the overall law in the UK. I think it needs to be universally applied here as well. Our courts are clogged up with frivolous lawsuits ( I know I was a victim of one where I was not a defendant, but my real estate was tied up nonetheless. At one point where I asked the judge for some relief, he said: “if you want some relief, you need to sue someone here.” As a consequence, we sat in an rental and waited for 18 months while “the process” worked it’s way to conclusion. And during that period of time ( the Jimmah Cahtah Admin.) construction lending went from 8% to 18%.

I’d rather see the idiots fork over ... to discourage others. Bad enough that the defendants had to waste their time dealing with this crap ...

The parents should made to pay. Maybe this will discourage frivolous lawsuits that are basically extortion. Some settle because they cannot afford to go to trial.

Also, it really wasn't the gun's fault. Does Ms. M. also support people sue manufacturers of knives used in killings?

Who cares what Madcow *blasts*? How many viewers does she have? 12?

She probably gets more attention with this thread than she does from actual viewers of her *show*.

Most of Europe is this way, one of he few things they have right.

They reduce frivolous lawsuits greatly so that the courts have more time for truly genuine cases to be heard.

And they don’t care about kickback careers to shyster lawyers.

There is such a statute and their lawyer should have known about it and told them before suit was filed. If he didn't know about it they may have a malpractice claim.

The statute is superfluous, however, because another Colorado statute provides that if any suit for personal injury is dismissed on a pretrial motion for failure to state a claim upon which relief can be granted the defendant may be awarded reasonable attorneys fees. These people should just pay up and not waste any more of their money on lawyers pursuing frivolous claims.

Why should they be allowed to sue the manufacturer in the first place? Absent some very special unusual odd facts?? It sounds very much like a pure nuisance suit just trying to shake ( extort)!some money from a “deeper pocket” than maybe the proper defendant may have.

Maddow is one of those people whom I full expect that one day, we’ll refresh FR, only to find that she painted a closet with her own brains, drove off a bridge, or was found dangling from a rope in the garage.

Absolutely. The arms manufacturer could easily say, “no, that’s ok, you’ve been through enough.”

I don’t agree with having brought the lawsuit, but I can also see people going through that kind of grief maybe not acting as they normally or rationally would.

If you watch Maddow for even 5 minutes
you’ll easily see this is her modus
operandi, and it is the same for the
entire Left:

Take a story and twist it slightly to
make out of whole cloth new victims
of conservatism.

In this case, the shooter’s victims
families wanted a payout from the gun
industry, but MadCow paints THEM as
the victims, not the aggressors in
a frivolous law suit.
