This is a stupid lawsuit. It was a company-issued phone...she had no right to install or remove any app without permission of her company.
If she's complaining about her company monitoring her when she's off-duty, then turn the blasted phone off or leave it at home when off-duty. Or if the company requires her to have her phone with her at all times, spend a couple of bucks and use this:

Turning smart phones off does nothing to turn these apps off Smart phones are traceable on or off. and one cannot take out the battery. Who said we are not becoming watched slaves?

She was REQUIRED to be reachable at all times.
It is UNREASONABLE to be TRACKED at all times.
With that app installed you can not be reachable and untracked.
You can record mileage without tracking.
