Which, in a sense, is the ‘perfect crime’ as to one can’t defend oneself from it - providing the ‘attacker’ turns around and walks away after hitting one once.

So if the dude knocks you down or stuns you with one punch and is walking away and you draw and shoot him, (according to whatever ‘code’ is being used today) chances are pretty good YOU will be charged as he (supposedly) defused the situation by walking away.

That idiot Mayor in Balmr got roasted for her ‘its only property’ remark, when - in effect - it has been that way for about 40 years....

Wasn’t so long ago that one was allowed to protect his property on his property - so the guy stealing your car out of your driveway was basically the same as being in your house, subject to the same ‘rules’... the ‘rules’ got changed to ‘why shoot the SOB when you can replace your car’, forgetting that may be your only way to get to work, the papers etc in the car were ‘gone forever’ but you would go to jail for popping the car thief.

IMNSHO, that was (along with LBJ) the beginning of the end - it emboldened thieves -

It would be fun if the one receiving the sucker punch explained his shooting of the retreating attacker must be excused because of temporary diminished mental capacity due to the punch to the head.

Sadly only too true, as was indicated in the celebrated case of Farmer Tony Martin. In 1999, after being burgled ten times and furniture stolen, he obtained a shot gun. His farm was a remote dwelling. Three individuals styled as so called "travellers"( itinerant losers posing as gypsies). burgled him again. He shot downwards as they ran. The 16 year old Barras bled to death. No one near to get help.

Martin got 9 years prison. A public outcry got him parole after 3 years. Originally charged as "murder". Also with not having a gun licence. Barras had 29 arrests on his record. At least the system gave the other two with Barras 3 years and 30 months durance in jail.

Under English Common Law a man's home was his castle and you could use deadly force in defending it. You could go as far as setting "man traps"! Ie: dead-falls, pits, spring guns, &C.

That was then, this is now.

If you use deadly force in defending your property you probably will be charged at the minimum w/ manslaughter. Could be worse depending on circumstances.

It won't be long before the Magna Carta is superseded by Sharia law.
