Is it up to the states attorney to decide? Or are there some rules about when a grand jury is necessary.
Bottom line why was there a grand jury in Ferguson but not in Maryland?
Well her charges indicate that she thinks that they intentionally killed him.
The reason why there was a grand jury for Ferguson was that the DA did not want to be accused of favoratism toward the cop.
The persecutor prosecutor can decide whether or not there is enough evidence to bring charges without a grand jury.
That’s cool.
I support grand juries. probable cause is not a high threshold at all.
Now we have a case were it looks like the state attorney is favoring a street mob.
After seeing the video of the DA’s remarks, it has confirmed an impression I have had for a long time. For decades now, I have observed a totalitarian streak with many of our minority office holders and public figures. The Jackson’s, the Sharpton’s would trash the Bill of Rights if ever given a chance. The rule of law means absolutely nothing to these people, it is mob rule and revolutionary tribunals that strike their fancy.
Follow on question: If a grand jury is optional for an indictment why have one? (Often wondered about the grand jury system and why it was needed.)
Sure she over charged them, like they say “throw enough shit on the wall and some of it will stick”. She is not interested in justice she wants a conviction against cops, it paves the way for any political career going forward.

I think she should consider her career over. She’s not going to win this and Baltimore will burn.

Not so strange if a jury is allowed to consider lesser charges. If not, then she’s done them a favor in the long run as without direct and corroborating testimony, they’ll never find them guilty of first degree murder — or whatever the top murder charge is in Maryland.
I’m surprised nobody mentioned the DA’s screw up: “they illegally arrested Mr. Gray”. I don’t think there is such a crime.
I think the point is to delay the burning.
There is no "crime" of illegal arrest but there is the fourth amendment.
About 8 to 12 months from now will be when it all blows up.

I know, but police are given sooooo much deference with arrests that it’s surprising charge and probably best left to the Feds.
That’s not the worst of it. I just finished watching the entire press conference with the State Attorney. She fell into a flat out political/racist speech. She really does need to recuse herself.

Officer Caesar Goodson Jr., 45, who was the driver of a police van that carried Gray through the streets of Baltimore, was charged with second-degree murder, manslaughter, second-degree assault, two vehicular manslaughter charges and misconduct in office. A man who answered the phone at Goodson’s home declined to comment and hung up the phone.
Officer William Porter, 25, was charged with involuntary manslaughter, second-degree assault and misconduct in office.
Lt. Brian Rice, 41, was charged with involuntary manslaughter, second-degree assault and misconduct in office.
Sgt. Alicia White, 30, was charged with involuntary manslaughter, second-degree assault and misconduct in office.
Officer Edward Nero, 29, was charged with second-degree assault and misconduct in office.
Officer Garrett Miller, 26, was charged with second-degree assault, misconduct in office and false imprisonment.
Looks like the highest charge is 2nd degree murder on the driver of the van.
I suppose the false imprisonment charge is related to the arrest based upon the pocket knife, which appears to me to be a mistaken arrest.
I am curious if every policeman who arrests a person on charge that later does not hold up for whatever reason is charged with false imprisonment.
In Baltimore, it is not optional. She has to take the case to a GJ within, I think, 30 days. What she did was to announce that there was probable cause so they could be arrested.
