Senator Ted Cruz has submitted legislation to create a constitutional amendment to allow states to determine what marriage is, and not federal judges.
Days before the U.S. Supreme Court hears arguments on same-sex marriage, Senator Ted Cruz has filed two bills to protect states that bar gay couples from marrying.
Cruz's legislation would establish a constitutional amendment shielding states that define marriage as between one woman and one man from legal action, according to bill language obtained by Bloomberg News.
A second bill would bar federal courts from further weighing in on the marriage issue until such an amendment is adopted.
You know, nearly all the the candidates running for president say that marriage should be decided by the states. That's an easy way of saying nothing of substance. Since federal judges have taken away the states' ability to decide what is and isn't marriage, saying you favor "the states deciding" doesn't change the reality of what is about to happen: as most people expect, the Supreme Court will legalize gay marriage throughout the country. (My personal prediction, as an attorney who watches these things: it will be a 6-3 vote, with John Roberts siding with Anthony Kennedy and the liberals because he wants to be on the winning side.)

Well, if it’s in the amendment itself, then of course it’s constitutional as soon as it’s ratified. I thought you were talking about some rule Congress had set up apart from the actual amendment itself.
Again, an alternative that bypasses such limitations is the Article V COC process but it looks like Cruz want to show this going to Congress which is dangerous for the reasons I mentioned earlier.

And, if Cruz “changed his mind”, kinda like Walker, you would say he flipped flopped...and then you, and other hand-wringers on here would say “well, he flipped on the issue, now I can’t support him”.

The first stated purpose of the United States Constitution is "to form a more perfect Union." The trendy "leave it up to the states" position on marriage, which is what the Cruz Amendment represents, makes the fulfillment of that purpose, and all of the other stated purposes of the Constitution, quite simply, impossible.
Moral civilization that recognizes and conforms itself to God's will and nature, and deeply immoral barbarism, which is in rebellion against God and nature, cannot co-exist peacefully over the long haul, or aspire to, and work towards, perfect unity. That's simply not reality.
This proposed amendment is fundamentally flawed.
If you're going to go to all the trouble of amending the Constitution, at least protect marriage, and the natural law, everywhere in America.

Immigration has accounted for something like 82% of the population growth in the US over the last 10 years. That is, without immigration the US is on a declining population pattern the likes of which as sent Japan’s economy into a death spiral. Tell us how you would maintain a growing economy without the stimulus of a growing population. It CAN’T be done.

Walker? He says he is against illegal immigration but he’d be ok with it if the economy is good. May be his corporate donors can wait til lmfeb 2017.

I do believe in unalienable rights but nothing’s perfect and it is the pursuit of perfection the misguides so many and leads to unintended federal abuse, socialism, and tyranny.
Freedom means everyone doesn’t have to abide by my moral code or your moral code. People can do what they want as long as they don’t interfere with another’s freedom. A happy, peaceful, and free society is never brought about by more federal power or even more state power - that is the direct opposite of freedom. But as the Founders wrote, sustained freedom is VERY dependent on the religion and “good manners” of the people.
Thus the banning of prayer and the Bible in public schools while seemingly harmless at the time, has reaped disastrous effects and harm to our free way of life.
Why?
But the “real question” here ... is ... “Is it constitutional if it is not ratified?” ... :-) ...

Congress can take marriage out of the purview of the federal courts without any Constitutional amendments.
To bad Lincoln himself felt what he thought was important trumped the Constitution which he ignored to proceed as he wished.
Favoring increased legal immigration also gives him political cover to take a stand against illegal immigration. It makes it harder to call him anti immigrant. This is a smart tactical move since illegal immigration is the more important issue. Let’s let Cruz get illegal immigration under control now, then we can adjust down the number of legal immigrants coming in later if need be.

Why do you want to keep importing democrat voters by the millions into our already over crowded nation that is becoming totally democrat, based purely on them importing immigrants to overcome our vote?
