I’m assuming you’re not a lawyer? Otherwise you would know the difference between first and second degree murder. This is second degree, tops.
Although I am curious what the thing is that falls away from the cop (behind him) just before he draws his weapon and fires. Unfortunately, the cop and shooting victim are obscured just before that moment. Did the guy go for the cop’s weapon, only to dislodge the taser, resulting in the cop reacting defensively?
If so, that’s clearly heat of the moment and 2nd degree tops. Either way, I have no clue how you could possibly say the cop’s actions were premeditated.

Do you mean the thing he PUT BACK NEAR THE BODY? That thing?
I think there was a case where a crazy Vietnam Vet killed a cop in SC some years back. He got the death sentence of premeditated even though he was crazy amd didn't pull over anybody.
If you go to the You Tube video posted earlier in this thread, you’ll see an unobstructed view of the beginning of the conflict, towards the end of the clip. The taser appears to be on the ground in front of the officer and there is a cylinder rolling away behind him. It might be a can of pepper spray or something else. It appears the taser was picked up and moved. Unless he laid eyes on it, he probably never knew the cylinder was gone. The officer might have had the world’s worst duty belt technique or he may have had help in dislodging his equipment.
