No, he wouldn’t have. A taser on or near somebody who was shot at a distance, with all of the several entry wounds in the back, does not constitute justifiable cause, and the cop would not have gotten away with it.

Yeah, he would have. Claim struggle for the taser, the perpetrator took it and was armed, he shot a fleeing, armed suspect. Police have gotten away with less.

Fortunately, I think that this was so blatant that nobody is going to be able to make hay on it. Even the police chief started crying when announcing it.

Fortunately the authorities were out in front of this, yes. Hopefully that will prevent this from becoming a national circus.

My daughter, who lives there, told me that the victim’s family doesn’t want this to turn into a circus and they are confident justice will be done. But of course, NAN (National Action Network) is already on the scene, and Al Sharpton is probably catching a flight even now to get there and cause trouble.
