Why Chief Justice Roberts will save Obamacare again

The Supreme Court’s credibility is at stake in Wednesday’s argument

While the Obamacare challenge being argued before the U.S. Supreme Court Wednesday is not an easy case, it does hinge upon an inescapably far-fetched claim—one that, if it prevails, will cause deep, lasting damage to the court’s credibility in the eyes of about half the nation’s population.

I suspect Chief Justice John Roberts, Jr., won’t let that happen.

The challengers’ central argument in King v. Burwell is that the Affordable Care Act—the signature achievement of the Obama Administration and the most significant social legislation in a generation—must be given an interpretation that no legislator, no analyst, no journalist, and no pundit ever anticipated, aloud or in print, prior to its passage.

If accepted by the Court, this reading will immediately render the care provided by the Affordable Care Act unaffordable to about 7 million enrollees in at least 34 states. It would then likely force many health insurers to withdraw from the program (due to erroneous actuarial assumptions), while forcing those remaining to raise their premiums, in turn forcing still more enrollees to drop out, in turn forcing further premium hikes, and so on, in what health care economists refer to as a “death spiral.”

Well, lots of attempts from lots of quarters to motivate the Supreme Court to make an incorrect decision so as to “save” Obamacare. Hopefully the egos of the likes of John Roberts and Kennedy are not so fragile that they can be manipulated by such thin gruel.

The American people really need to start taking the stolen power away from these black robed tyrants. The Founding Fathers NEVER intended for these activist bastards to have the power that they now have. These tyrannical fags have the power to trump everybody. Where the hell did that come from? It sure as hell isn’t in the Constitution or Bill of Rights.

The Chicago Mafia has something big on Roberts, or he would have killed Obamacare in his first outrageous ruling that its penalty was a tax. He thus rewrote the bill to save it, so why would he rule against it now?

There is a 0% chance that Roberts will side with conservatives on this. There is no suspense here. ObamaCare will be upheld. Statism is the order of the day, and will not be permitted to be challenged.

If SCOTUS does make the correct ruling, the GOP will pass a bill to provide the subsidies. Ocare is not going anywhere.

The Constitution and the welfare of the American people be damned. The prestige of the Supreme Court must be saved at all costs!

I think all of the Founding Fathers would be appalled at the power now wielded by the federal government--even Alexander Hamilton, who was in favor of a stronger government than most of his contemporaries.

The talking point for adopting Obamacare was that 45 million Americans lacked health insurance. So now 7 million are signed up and the law is supposed to be a great benefit to the nation?

Why? Or why would blackmail over his illegally-adopted children be the reason, as others have suggested? Roberts is a Statist. The man who appointed him (and his brother the candidate) is a Statist. It doesn't help us to remain in denial about how deep is the rot that has penetrated the Republican party.

I think it’s 50-50 - and I don’t trust Roberts, but King is a very strong case, and Jonathon Gruber’s video idiocy reinforces the King case since Gruber’s comments are part of the case.

I think Roberts established his OC credentials with the mandate/tax/penalty wizardry.

I don’t think there is a 1 in a 1000 chance the court will rule of the side of constitutional law.

John Roberts does not mind the immense damage he and others have caused to 10’s of millions of people with obamacare.
He just does not want to be hated by the democrat party members at the dinners he attends.

Agreed. And several of the GOP-led states that resisted setting up state exchanges are now scrambling so they don’t get blamed, if the law should get overturned:

This article is an hysterical attempt to rewrite history.

It ignores the well-documented history of Congressional compromise that led to the current bill, and instead tries to convince us that the language was "stumbled upon" after its passage. It even downplays Gruber's role in it.

Roberts sees to be highly manipulable as witness the contortions he made to uphold it the first time.He likely won’t make a decision now that might suggest he should have ruled otherwise last time.
