If she wins, I’m curious if the insurance company can then sue her.

In the UK, a burglar won a lawsuit against a property owner who shot him because he was too frightened to continue in his chosen career - burglary.

Insurance companies should cover accidental death of a person. Usually the more sticky cases are the intentional deaths - like not paying out if someone deliberately kills themselves (suicide clauses).

Maybe not all of the story is being told here.
