Flintlock from 1700s could land elderly NJ man in prison

A retired teacher is facing 10 years in prison and the loss of his state pension for possessing a flintlock pistol that may not have been fired since George Washington was alive, his attorney told FoxNews.com on Wednesday.

In a case that underscores the Garden State's strict gun laws, Gordon Van Gilder, a retired English teacher and collector of historical items, has been charged with criminal possession of a handgun and faces up to 10 years in prison. If the 72-year-old is convicted, the charge carries a mandatory minimum sentence of 3.5 years and the pension Van Gilder earned as an educator could be revoked, penalties attorney Evan Nappen called "outrageous."

“It’s crazy," Nappen told FoxNews.com. "The gun was unloaded and strictly possessed as a historical relic. We’re hoping the prosecutor will exercise discretion and dismiss his case.”

After 34 years you would think he would have realized that his is living in a Third World State and those Bill of Rights he probably taught in school don’t apply there.

Really??? Were you using real hard home cast balls? I have 1858 New Army Remington’s and I’ve shot them without lubing over the balls.

BTW, Crisco IS a great idea for the lube, and way cheaper than the commercial I bet. Wonder how it does in the heat?

licensing? Where? You don’t need licenses in CA for those even. You actually don’t need “licenses” or registration in most normal states for regular firearms.

Crisco IS a great idea for the lube, and way cheaper than the commercial I bet. Wonder how it does in the heat?

Kind of a gooey mess, which is why I mix it 50/50 with beeswax and then use an empty .45 Colt case to cut out the cooled mixture and use than as wads over the lead balls.

My older Brother found an 1851 Colt Navy buried in his in laws back yard. It was, as one might imagine, heavily rusted but incredibly, by using new parts from Dixie Gun Works he restored it to firing condition.

That’s federal law. NJ is entitled to a completely different definition of guns.

I had to look it up since I have never owned a Walker but to my surprise, you are correct. I wonder why they call it a .44?

Actually it said they take round balls up to .457 which is really 46 caliber. I do know .44 magnums take .429 diameter bullets as I have owned a bunch and used to reload for them too.

Because that's what folks were used to calling them back in the late 1800s. All the Remington and Colt's percussion .44 revolvers were actually .45 cal: .451 and .454, Remington did make a cartridge revolver in 1869 that used a conversion cylinder on a percussion revolver in .457, a .46 cal. The 1873 44-40 Winchester is a true .44 cal at .429.

Yeah, I checked and even pellet guns and slingshots are illegal in New Jersey under state law.

New Jersey may have a totally different definition of guns, but the rest of the country is going to have a very different definition of what it takes to be President if Chris Christie decides to run for president.,
