Watch him EO himself a way to circumvent this.Since he's never produced the original EO on this topic, my suspicion is that he will produce one now which will throw the case back to the court(s) for another round, and Homeland (which, let's be honest, is a Nazi word) will proceed unhindered.

Yes, it is very rare, but it can happen.
It will probably be put in a very fast track to be review by the 5th district court.
Odds are that this decision will hold with that court.
