He is citing the Obama Doctrine for legal authority. (Picking and choosing what laws to enforce).
What the Federal Courts need is a lot more defiance. They jumped the track back under Roosevelt, and haven’t been sane since then.
Here’s hopin’ Alabama don’t cave. This unconstitutional behemoth that the federal government has become needs to have its leash jerked.

I would look for President Cruz to nominate Moore to the SC; at his earliest opportunity, I do not think anyone in the current 2016 line up but Cruz would have the courage or the confidence in his abilities to get Moore seated on SC.
An unjust law is no law at all. To equate refusing to enforce an unjust court ruling to refusing to enforce just law passed by legislation is to espouse the same kind of moral anarchy and equivocation as Obama.

You beat me to it. An unjust law is contrary to reason. It’s more like an act of violence than any real law.
While would also expect a President Cruz to appoint strict Constitutionalists to the Supreme Court I also think that he can, and he will, do a whole lot better than Roy Moore.
Do I detect a pattern here? That is, does AllahPundit bat for the other team?
Since the various states simply accepted the USSC’s ruling legalizing killing unborn babies (abortion), it’s unrealistic to think they’d resist a USSC ruling legalizing same-sex marriage. Simply declaring something legal does not make it right. Abortion and marriage issues are clearly outside the purview of the USSC and any ruling regarding them should be ignored by the states.

As will I. But I would also expect a President Cruz to choose better candidate for the court than Roy Moore.
Roy Moore has support of most of us in Alabama.
And I think he should continue as your state Chief Justice. But I don't see him on the Supreme Court. Take this article for example: "I refuse to enforce this federal court ruling legalizing gay marriage." What exactly does that mean? Does the Alabama Supreme Court issue marriage licenses? I don't think they do. So in point of fact Moore doesn't enforce anything. It's up to the local administrators to refuse to uphold the law and the question is if they or your state government will do it. Moore is out of the loop. And if they do refuse and someone sues, as someone is bound to do, then it'll probably be in federal court and not state so Moore won't be able to rule against gay marriage.
What I think this is all about if another try for elected office; governor probably. He's tried that twice before.
