Gay activists unsurprisingly don’t understand the dual state / federal government system of our constitutional republic. Consequently, they don’t understand that because the states have never amended the Constitution to expressly protect gay agenda issues like gay marriage for example, the feds have no constitutionally enumerated gay “rights” protections to apply to the states via the 14th Amendment.
So regardless that pro-gay activist judges are wrongly using PC interpretations of 14A’s Equal Protections Clause to argue that 10th Amendment-protected state bans on gay marriage are unconstitutional, it remains that the states are free to make laws which discriminate against constitutionally unprotected gay marriage imo, as long as such laws don’t also unreasonably abridge constitutionally enumerated rights.
