A former Fort Bragg Army officer will remain in prison on murder charges for the slayings of two Afghan nationals in the Afghanistan war, Maj. Gen. Richard D. Clarke of the 82nd Airborne Division has decided.
Clarke, the division's commander, was considering a clemency request from former 1st Lt. Clint Lorance. Lorance was court-martialed at Fort Bragg, N.C., in summer 2013 for ordering his soldiers to shoot at three Afghans while on patrol in summer 2012. Two of the men were killed, and the third ran away.
Clarke cut a year off Lorance's 20-year sentence but otherwise upheld his convictions and punishment, a Fort Bragg spokeswoman said this week.

Lorance's lawyer, John N. Maher, has said he has obtained evidence that connects the men on the motorcycle to people who have committed bombings in Afghanistan, and this should show that their deaths were justified.
None of Maher's evidence directly implicates the two who were killed.
Maher's new evidence suggests the third man, said to be the brother and uncle of the two who were killed, was involved in a bombing two months after he was attacked by the Americans.

This happens during a time of war. If an approaching person looks to present a danger, you must act. I thought liability for prosecution was one of the main reasons we pulled out of Afghanistan anyway. Now, we are judging our own American soldiers as guilty of criminal behavior.
I don’t mean times when a deranged serviceman truly does go nuts and kills scores of innocent civilians. Sadly, that did happen a couple of times. Hopefully, this man can hold on till we get a new president who may revisit this conviction.
Don’t hurt the enemy...it might make them angry. Besides, it’s probably racist too!
And how many soldiers deaths is Bergdahl responsible for?
Don’t worry. I’m sure the lesser evils we sent to DC on the demand of staunch right wing rock Ribbed conservatives, will trip over themselves getting this man justice.
Because thats what lesser evil does. Fights injustice. So fear not. When all the people on the threads the last couple days rally to the Romney cause as they have been, you know that the severely conservative winner who is famous for his love of the American military, will pardon this man and others railroaded by PC as his first act in office.
As much as I respect the individuals in the military, as a whole, it is still a government bureaucracy that must conform to the political winds and attitudes of Washington DC. Its dangerous to be a US soldier with the present administration. Political correctness casualties will be high.
This action by Clarke is evidence of reasonable doubt regarding guilt.
Lorance, at the least, deserves a retrial.
