A Long Island Tea Party member is getting the last laugh after being awarded 1.12 million dollars in compensatory damages. Nancy Genovese, 58, a mother of three, was arrested in 2009 for attempting to photograph a helicopter at an Air National Guard base in the Hamptons. She claimed that she was only arrested during the incident because she belonged to the Tea Party. She intended to use the photo on a Support the Troops website; she was arrested for trespass and insulted as a Teabagger.

We have won at trial today!! From July 30, 2009 until tonight, December 11, 2014, my family, my three children and I have lived a nightmare of labels and lies, begun by corrupt Suffolk County Law enforcement - Sheriff Dept., has ended. Trial began Dec., 01, 2014. Tonight the jury returned a favorable verdict - “Malicious prosecution.” This is day of celebration - another case of corrupt police, handled in our justice system, resulting in a winning verdict against the county of Suffolk County Sheriff’s Office and the arresting Deputy Robert Carlock!
In criminal court, the one charge, Deputy Robert Carlocks fabricated charge of trespassing 3 was dismissed Nov., 17, 2009. I was on a county road in my convertible. I was labeled “...a right wing, teabagging, ‘terrorist...” by the Suffolk County Sheriffs, Under-sheriff, and deputies, using their fabricated, press release, July 31, 2009, in the media, the press and across the internet. I was kidnapped from my children, with no lawyer, no calls, lied about, spend 4 nights and 5 days tortured in jail waiting on $50,000.00 bail.
In civil court, tonight, a jury of my peers has rendered a verdict against the arresting officer Carlock, the county and Sheriffs depts.,
We wish to thank the Jurors, my two law firms, Myron Beldock and Levine, Myron is at 99 Park Avenue, NYC and the Long Island Firm of Fred Brewington, and partner Ira, located in Hempstead, NY - Thank you! I especially wish to thank the judge who we found to be a very fair. Regardless of the outcome, I have the same opinion of the judge. The judge is a man of honor and great professionalism. Thank you!
Above all we thank you Lord Jesus! Anyone wronged by those we pay to “protect and serve” - this winning verdict is for you as well. We will begin a foundation and / or join forces to organize into something very powerful.
We will fight injustices on their own level, in the courts of law!
God bless and be safe friends!
- Nancy Genovese
Kidnapping by law enforcement, by the Government. Violation of civil rights.
In summary, the three officers identified:
Southampton Town Police Lieutenant - Robert Iberger
Suffolk County Undersheriff - Joseph T. Caracappa
Suffolk County Sherriff Deputy - Robert Carlock.
What would you charge for 5 days in jail and being strip-searched for being a conservative?
This story is almost a month old and has been repeated here on FR numerous times since the jury verdict on December 11th. Note that the $1.2 million is for compensatory damages with the jury yet to decide the issue of punitive damages.
My understanding is the Ms. Genovese, like a lot of tea party supporters, is somewhat of a vocal gadfly who has been highly critical of the high costs of government on Long Island where there are multiple levels of overlapping police agencies, which in the opinion of many, are a huge and unnecessary burden to the taxpayers. In Suffolk County (where she was arrested), for example, nearly every town and village has its own police department. Then there is the Suffolk County Police Department, Suffolk County Sheriff’s Department, New York State Police, NYS Department of Environmental Protection Police, MTA Police, Port Authority Police, NYS Mental Health Police, NYS Park Police, State University of New York Police, Suffolk County Community College Police, ASPCA Police, and I’m sure that I missed a few. Many of these police officers — particularly in the Suffolk County Sheriff’s Office where the arresting officer at issue is employed — have a six figure base pay with excellent benefits, and make over $200,000 a year with routine overtime.
“Maybe take the money out of their pension fund and theyll start to care about peoples rights...”
Bingo.
Yes, I’m sure the “teabagger” commnent went a long way in demonstrating that it was malicious.
Wait- she won this verdict without stomping around the streets holding up signs? She never interrupted people’s Sunday Brunch by acting like a feral moron? She never even chanted ‘no justice no peace?’
Wow. Will wonders never cease?
The taxpayers lost that million plus a couple more in court fees, etc.
..NYS Department of Environmental Protection Police
MTA Police
Port Authority Police
NYS Mental Health Police
NYS Park Police
State University of New York Police
Suffolk County Community College Police
ASPCA Police
Punitive damages?
Oh baby, the punitive will be HUGH! This is series business.
Unless the parties settle to avoid the risk of reversal (unlikely) on appeal.
“Maybe take the money out of their pension fund and theyll start to care about peoples rights...”
Like!
I think she should have walked away with ownership of all the town’s assets. Money talks. This lefty and cop bully nonsense has to stop.
Just for the record, NY isn’t NE.
