A Long Island federal jury rewarded Nancy Genovese, 58, a mother of three, $1.12 million in compensatory damages after being arrested in 2009 for attempting to photograph a helicopter at a Air National Guard base in the Hamptons. Genovese intended to use the photo on a Support the Troops website; she was arrested for trespass and insulted as a "Teabagger."
From The New York Post: Southhampton cops searched her and found a legally owned rifle that she was transporting from a nearby rifle range. She contends a deputy sheriff arrived on the scene later and said to her, I bet you are one of those Tea Party people. When Genovese said shes gone to Tea Party rallies, he allegedly said, Youre a real right-winger, arent you? and You are a Teabagger and then added that shed be arrested for terrorism to make an example of other right wingers.
What they took from this woman cannot be measured in money, said her lawyer Frederick Brewington. There is no reason to treat another human the way they treated her.
Ms Genovese was subjected to a level of abuse because they did not share the same political views as she did and saw this as an excuse to deny her even the most basic civil rights, he said. After she won, Genovese said she wants to start a foundation to help others who were wrongly arrested.
"This was the ultimate rude awakening," she said. "At any given time, anybody can be arrested and can be held on excessive or no bail."

Too bad she was not a black tea partier, then we would really have had fun with that one
If you really think your free, drive over close to a power plant and start taking pictures.
You will get a chance on make new friends.
Geez, where have you been, lady?
That's been the law of the land since 2011 (HINT: google "NDAA").
And you've been on the terror watch list since 2010 (HINT: google "DHS SPLC Domestic Terrorist").
Dude.
“Teabagging” is a homosexual sex act.
It’s a surprisingly sophisticated insult by Leftists, implying that you are not only their political opponent (and who they would rather see dead), but that you are in reality a closet homosexual and a hypocrite.
And yet they arrested her for a lawful, even innocent action. They had it in for her and that’s why I believe the comments, although it doesn’t matter to anyone if I do or not.
Does anyone think she’ll ever actually collect the $$$? Or will it all be whizzed away over several years of appeals by the cops and municipality? There may be one winner; her attorney(s). The longer it drags out......
What is that deputy sherries name and does he still have a job?
“Property taxes will necessarily skyrocket.”
He should be stripped of his right to carry a firearm.
He doesn’t seem to be in control of his mental faculties.
> Isn’t it grand to live in the “ Land of the Free”
Especially when the Left takes away YOUR money and gives it away freely to others to get their vote?
> -anyone can be labeled a terrorist these days.
Especially if they believe in truth, justice, constitutional law, and pay their taxes. If you aren’t a gay celebrity status sociopathic hedonistic, narcissist liar, thief, and murderer the Left hates you.
And here I thought Islamic extremist were the enemy, not us.
“I disapprove of what this cop did, but I
don’t really see anything in the
Constitution that prevents cops from
saying insulting things.”
He is acting on behalf of the state. When he degrades a citizen, the government is degrading a citizen. Any cop who can’t control himself and behave properly at all times when on duty should be fired.
Remember, he dishes out his abuse whilehiding behind a badge, making it risky to return his fire.
If he did as claimed, he behaved stupidly. :)
My comment was with regard to the Constitution. Can you point out the clause prohibiting officers of the state from saying mean things to citizens?
Particularly as this was not a federal officer.
The Southern Poverty Law Center has a list of terrorists organization and terrorists profiles that the Federal Government uses to determine whether one is a terrorists or isn’t terrorists. Christians, White males, and Constitutionalists meet all the criteria to be a terrorists. Muslims and those who advocate the violent overthrow of the Government of the United States meet none of the criteria of a terrorists.
The money should come out of the Sheriff’s Office budget, but it won’t.
A cop is a representative of the Government, to wit}the Executive Branch. Everything he/she does reflects the Government’s point of view. His/her actions have the full power and authority of the Government behind them.
Is it constitutional for the government to degrade a citizen? That is the answer to your question. How a cop is allowed to behaves, while representing the government, is how that government behaves.
Yet another insight into “thinking” by big government. They refuse to protect us from illegal immigration (and potential terrorism via the Southern border), and perceive those with differing political or religious opinions as a terrorist threat. Don’t think for a minute that incidents like Waco or Ruby Ridge were aberrations. In one generation we graduated from shooting war protestors to using tanks and flame throwers against American women and children. Wake up. This is what you get.
There’s an “or” after this, this is the applicable part to her...
“willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution”
He detained and subjected her to an illegal, warrantless, arrest under color of his authority.
I reiterate, the subject of the law is TWO parts, which is an abuse of a citizen covered by the constitution and an alien not so.
I believe that many do not pursue this exactly for the interpretation you got from it.
