Eric Garner Would Be Alive If He Was Not Obese, Says Rep. Peter King, Thanks Grand Jury For Decision By Suman Varandani@suman09s.varandani@ibtimes.com on December 04 2014 12:44 AM Dec. 3, 2014. Reuters/Stephen Lam Peter King

Rep. Peter King said Wednesday that Eric Garner would not have died from a police chokehold if he had not been obese. (He was 6 feet 3 inches tall and weighed 340 pounds.) Kings comments come after a Staten Island grand jury decided not to indict NYPD Officer Daniel Pantaleo for the chokehold death of Garner, a move that has triggered protests across New York City.

The U.S. representative for New York's second congressional district reportedly said during an interview with CNNs Wolf Blitzer that Garners health was to be blamed for his death. King also dismissed video evidence that showed Garner repeatedly saying he could not breathe as officers tackled him to the ground and choked him, stating that "police had no reason to know that he was in serious condition." The chokehold has been blamed for suffocating Garner, causing his death.
"If he had not had asthma, and a heart condition and was so obese, almost definitely he would not have died from this," King reportedly said.
"The fact is if you can't breathe, you can't talk," King reportedly added. "If you've ever seen anyone resisting arrest, I've seen it, and it's been white guys, and they're always saying, 'You're breaking my arm, you're choking me, you're doing this,' police hear this all the time."
In August, the citys medical examiner ruled Garners death a homicide and one that was caused by pressure to his neck and chest. Garners acute and chronic bronchial asthma, obesity and hypertensive cardiovascular disease were contributing factors in his death, the medical examiner ruled.
Garner was allegedly selling untaxed cigarettes on Staten Island in July when NYPD officer Pantaleo put him in a chokehold.
King also took to Twitter on Wednesday thanking the grand jury for its decision.
Wednesdays decision sparked unrest in New York City and has drawn comparisons with last months grand jury decision not to indict white Officer Darren Wilson in the shooting death of unarmed black teen Michael Brown on Aug. 9 in Ferguson, Missouri.
Protests continued Wednesday night as several demonstrators marched the streets of New York, while some blocked roadways and torched several vehicles, including a police cruiser. Police reportedly said early Thursday that a suspect had been taken into custody for setting fire to vehicles.
Police reportedly closed New Yorks Triborough Bridge, officially known as the Robert F. Kennedy Bridge, in an attempt to block protesters. Late Wednesday night, reports also emerged of police arresting protesters who were staging a sit-in on the Brooklyn Bridge, blocking traffic in both directions.
King could work for Bloomberg. Oh, that’s not supposed to be public knowledge.
“When cops are resisted, bad things can and do happen sometimes.
How would cops know this man hadnt just committed a murder down the street? Or, that he had a reason not to be arrested.”
I saw the video. Hands up, no aggression of any kind, deliberately avoids touching police, backing toward a wall. Excitedly (but politely) pleading to get out of arrest.
My question is... With the NY legal system overwhelmed and years behind in hearing serious cases, why was he being arrested anyway? What is the fine for selling 1 cigarette (a $0.65 item in NY)? Isn’t that citation material? Unless they were looking to harass him, shouldn’t they just have ticketed him for such a minor offense and been on their way?
No wonder they don’t trust cops!
Should they put everyone in a choke hold until it is determined that they are innocent of all crimes?
...
He wasn’t choked, and he committed a serious crime when he slapped the officer’s arms away as he was about to be arrested.
Ooesn’t the NYPD have bigger fish to fry than going after a cigarette seller? How about NYC stop ripping off its citizens having to pay huge bridge and tunnel tolls. Now that’s organized, legalized crime of extortion.
Ok. Assume the market for untaxed loose cigarettes is saturated because it’s no longer illegal. What other controlled substance would be ok for the victim to peddle?
Are cigarettes a controlled substance?
You seem to be equating cigarettes to crack but that can’t be right. That would be a an idiotic comparison.
How many cops does it take to arrest a man selling cigarettes. My gosh thats a major crime right there.
A veritable crime wave it is.
Look, he was a cig seller and tax evader in NY.
They’d had enough, in fact he was a 4x cig seller and failed to pay up, obey and comply.
Add up all those cig dollars over a few years and someone’s pension in the NY government could be affected. That is not tolerated and they have muscle to force payment.
It’s simple, do as you’re told...Pay up, and comply.
Otherwise ya might get your legs broken....Or worse.
Interesting questions. It appears that Hizzoner DeBlasio has designated ‘lost revenue’ from bootleg tobacco sales as at the top of the list for criminal activities the NYPD is supposed to go after. Hizzoner has become particularly incensed at the losey salesmen he encounters almost everywhere in Gotham and the other boroughs. He takes it as a personal affront and has made PC Bratton just how unhappy he is about and how he considers such open sales evidence that the NYPD is derelict in enforcing the law and just maybe contemptuous of the Dear and Glorious Leader. So NYPD operations at precinct level are feeling the heat to show lots of pro-activity and get those arrest stats up for the crime of losey selling.
Yep!!!!
Funny stuff.
Ya don't want to have your legs broken or be found in the river...Just pay up and comply, then ya get to go home to the little wife. Capisce?
So he isn’t really dead?

Eric Garner seemed to think he could fight them all off.
They are regulated, and were they not, what do you suppose the victim would peddle that would have similar marketability? The obvious point is he would have found something. Probably something Illegal.
He resisted arrest. Rule number one is when a cop says you are under arrest, you comply. Something he should have learned from his many previous encounters with cops.
Bratton isn’t the an he used to be-—————Wilhelm is walking all over him.
.
What did his skin color have to do with it.
You think all things being equal if he were white it wouldn’t have been the same outcome?
I think you mean this to the bigot and not me.
The cop woulda done the same to a white guy.
Fight? If that’s a fight to you then you must be pretty delicate.
The use of a taser would have had the same result. Why is the media not going after the black female officer who was reportedly in charge of the arrest?
What an absurd comment! BUT when he was saying he couldn’t breathe, he obviously was breathing or he couldn’t talk, much less yell. Or have you never been unable to breathe? Or in the company of one who truly can’t breathe?
The man was a good 150-200 lbs overweight, with a slew of medical conditions. He looked like he was 3-4X the size of the initial cop who tried to arrest him. He made a stupid, fatal decision. Or several if you want to go back to deciding to sell cigarettes illegally, however outrageous the NYC tax may be.
