Bill Cosby Sued for Sexually Assaulting 15-Year-Old Girl

As the number of sexual assault allegations against Bill Cosby grows, the comedian is now facing a lawsuit from a woman who claims Cosby molested her when she was 15. In a suit filed at Los Angeles County Superior Court on Tuesday, Judy Huth states that Cosby sexually assaulted her at the Playboy Mansion in 1974, the Los Angeles Times reports. The lawsuit marks the first time the latest wave of accusations against Cosby has resulted in legal action.

While the state of California can only pursue criminal charges against Cosby had the incident occurred in 1988 or after due to the statute of limitations, a civil trial could proceed if Huth can prove that she has developed "psychological injuries and illnesses" in the past three years as a result of the decades-old alleged assault.

Whether Cosby did these or not, what is the standard of which proof is available? Is there ANY physical evidence of his rapes and what is the statute of limitations? In a criminal case can it be proved without any doubt? In a civil case can it be pursued to success? After all is done, Cosby is toast but I don’t see any honest and truthful end to this whole episode. Cosby is wealthy enough to fight this off successfully. He should let his lawyers do the fight and fade into the dark. He’s being punished for his sins with the destruction of his future earnings. Cosby will face his judge after he dies.

Ol Hugh better get himself a lawyer too. Reading just that little passage I had the same reaction many of you probably had and that is “what the hell is a 15 year old girl doing at a party at the Playboy Mansion?” In addition to investigating Cosby some people will start asking what else was going on at Holmby Hills.

The shakedown has already started. Gloria Allred has asked Cos to hand over 100 million without even going to court.

We are in for a bimbo blizzard on this one.

If there was no money involved or available, not one word would have been mentioned, or one accusation made.

I don't think it's "either...or".

I think he's a sexual deviant and adulterer who took advantage of young women who were SUPPLIED to him by the same HOLLYWOOD/MSM personnel structure that has been there before COSBY, and still exists today. Hollywood is full of sexual deviants and adulterers. Then there is the music industry and all it's 'groupies'. That's what these girls were, for the most part... groupies. How else do you explain them repeatedly showing up to spend the night with Cosby in his hotel room, or house, or at the PLAYBOY MANSION ?

What about the 'adults' who supplied these young girls to Cosby, knowing full well exactly what would happen to them ?

it is dangerous to the alleged victims since they make sworn statements to the courts for which they can be held liable if untrue. The danger of lying after so many years is that Cosby might be able to pull out and publish something like an airplane ticket receipt and disprove a claim, making the alleged victim into a liar and a libeler. Many of these women are in their 40s, 50s, 60s, and 70s, not a particularly good time for them at their stage of life to risk being caught up in public as liars and in court as libelers. From reading the reports, I suspect that several of the alleged victims have formed a support group and have designated hitters lined up to hit Cosby in court, one after another. All it takes is for one alleged victim to gain standing in court (that is, successfully pass standard motions to dismiss), and then such a trial would enter the discovery phase during which Cosby would be called upon to give a disposition. At that point, he could either give a disposition answering all questions (which i think would be highly ill advised if he is guilty of anything), or take the fifth (in which case he effectively looks guilty in the court of public opinion, and loses face if not his fortune to settlements), or flees the country to someplace like France without an extradition treaty, a la Roman Polansky. Standard disclaimer: IANAL.

Yes, you do have to wonder. Like many things, I suspect the truth lies somewhere in the middle. My guess; Cosby was a sexual predator, and there are real victims out there. On the other hand, probably not to the extent that all of the persons claiming victim status were actually victims, and there is some gravy train hopping going on. And there are probably some real victims who have moved on and will forever remain silent, and watch his destruction from the sidelines with quiet satisfaction.

The truth, whole truth and nothing but the truth is known only to Cosby, his victims, and God.

I’m thinking the same thing. I don’t know whether is guilty or not or rape but what about consensual sex? Are most of these woman that were trying to get fame and fortune consented to sex and now see another opportunity to grab a dollar? I don’t know. But, the amount of woman coming forward seem to make him a serial rapist!

Yes, but I don't doubt that most of them were involved in an 'incident' with Cosby. The high numbers are no surprise as Cosby was a superstar in Hollywood. Girls would throw themselves at his feet, if you know what I mean.

AND THEY DID. If not, their parents or talent agent did.

In the end, the question is WHY NOW ?

It will require her to show she was unaware of any injury or damage for 37 years, but figured it out in 2011 or later. Seems to me that will be a tough sale, but I’m sure some doctor is willing to swear it is true.

Even in a civil trial this will be he said, she said.

At this point in time there is essentially nothing in the way of evidence other than the testimony of the two people involved.

That means the only way a judge or jury can make a decision is on the basis of which party tells a better story.

In a criminal trial, the standard of proof is beyond a reasonable doubt. Frankly I see no way at all I, as a juror, could vote for conviction in such a case. How could I not have a reasonable doubt when it’s one person’s word against another’s?

Some people are excellent liars. Others aren’t believable on the stand when they are telling the truth.

In a civil trial it’s preponderance of evidence. But we’re still back to actual evidence being balanced 50/50.

I’m sorry that rape, especially of the date variety, is so hard to prove in court, but somebody point out another crime for which we routinely convict people based solely on one person’s testimony, refuted by the defendant.

How can anyone defend themselves in a lawsuit from 40 years ago? Witnesses have died, memories fade, this is a gold mining expedition.

The problem Cosby has is the reason a statute of limitations exists - who keeps detailed records of what happened 40 years ago? I’m 56. In 1974, I was in the 10th grade. How could I prove anything about where I was or what I was doing on a given date in 1974?

My understanding is that a witness cannot take the 5th in a civil trial if the statute of limitations has passed.

The 5th protects against self-incrimination. Criminal charges not possible, it isn't relevant.
