A New York City grand jury has declined to indict an NYPD officer in the chokehold case of Eric Garner, the unarmed man who died while being arrested on Staten Island earlier this year.
In opting not to indict, the panel determined there was not probable cause that a crime was committed by NYPD officer Daniel Pantaleo, who was seen on a widely watched amateur video showing him wrapping his arm around Garner's neck as Garner yelled, "I can't breathe!" during the summer altercation.

That almost means he was attacking all these cops right?
This is a major quandry for the democrats, for they have demonized tobacco to the hilt and their demonization of tobacco caused Michael Garner's death. The cops should have been looking for murderers, rapists and drug pushers, not a guy selling a legal product. Bloomberg is also to blame for he gestapoizeded the police force with his war on cigarrettes.
Yet there was no damage to his neck and no sign of petechial hemorrhaging, which is very odd.
did you him resisting? I didn’t watch that close. Don’t have time to look again. Just remember some words and then 5 guys on top of him for what seemed like forever. If it seemed long to me, I can’t imagine how it seemed to someone unable to breath. So you saw resistance?

If that was the evidence before the grand jury, then we've got a bunch of hands-up-don't-shoot type of posters here.
There is one thing people here should keep in mind. We supported the decision of the Grand Jury in Ferguson and we were outraged that they would be demeaned for doing their job.
Now, I see people demeaning this Grand Jury. None of us heard the evidence in this case that was presented to the Grand Jury.
In this case all the evidence was not presented on both sides like Ferguson. There was no defense evidence presented and they still came out with this no bill.
chokeholds are illegal because this kind of thing can happen, if the chokehold caused his death then this cop should have been charged with manslaughter or reckless endangerment.
That’s the irony in ferguson the cop did everything his training said to do. Here a cop browk the law. Yet, somehow ferguson was a big deal and this wasn’t.

Baden did not say that compression of the neck was the cause of death in this specific case. He was speaking in general, like he often does when he jumps on a bandwagon case.
That is true. I am reading, albeit slowly, the Ferguson Grand Jury transcripts.
I would like to read exactly what they were presented with. I’ve never been able to serve on a jury. After I got done saying that I don’t like lawyers, I’m sure that I would be excused.
I think they think the guy died of strangulation. I also don’t think people think this guy was doing anything so bad to get jumped for a little resistance.
I think his crime was kind of petty. It is a shame he died over it. But I don’t think I would call it murder or regular manslaughter. Maybe negligent homicide or something like that.
The hold used on Garner is the sort of thing one may need to do if alone or maybe with another cop. I recall cops saying (years ago) “4 guys, one on each limb. When you are horizontal 4 feet off the ground, face down you ain’t going nowhere.” In Garners case this is about 90lbs a man.
My guess is in this case Garner has his heart attack anyway but at least there is no “choke” involved. Why send four guys if you don’t plan to overpower and immobilize him quickly?
You can believe that the sky is green but that won’t make it so. I’ve watched the videos a dozen times. At no time does the officer use a carotid or trachea chokehold. He uses a headlock which controls the head, used for restraint and is legal.

I agree. The coroner found no damage to the trachea or bones in the neck. And if a person can talk as Garner did, they can breathe.
I still have an issue with the care Garner received after he passed out, though.
Question: If someone dies during the inevitable riots, will the government count the death as "smoking related?"
