Look at the language State is using. The parents are described as "lawfully present". They're not described as U.S. citizens, or as Legal Permanent Residents (green card holders).

The weasel words "lawfully present" to me indicates that the parents are likely illegal aliens, but in some kind of deferred status, courtesy of one of the many Bush/Obama mini-amnesties for Central America.

This is being put in place so when the republicans cave on amnesty, not only will the 20 million here get amnesty, but their nephews, nieces, sons and daughters back in the south will also get amnesty.
