No news article to post-- the only article so far is in the Clarion-Ledger, which we can't post. But the Mississippi Supreme Court affirmed the lower court ruling that Chris McDaniel's challenge to Thad Cochran's primary win was filed too late. The Court's decision is here.
9 justices and only 4 voted to uphold the ruling, and they still win? On to the Supreme Court.
One day they kick your filing back as premature.
The next day they kick it back as too late.
A clear split decision. Appeals must now be based on criminal intent, voter and election fraud.
The US Supreme Court is not going to intervene in a state law case.
What I’d like to know is if there was this deadline why didn’t they file it on time?
There was no federal issue raised in the appeal-- the only question McDaniel raised was what the statute of limitations is under Mississippi state law-- so no appeal to SCOTUS is possible.

It's a state issue, why would the U.S. Supreme Court get involved?
I never understood why McDaniel waited to long to file even if he didn’t yet have all the materials he needed. As a lawyer, he knew the liberal court would be unforgiving of such a lapse.
McDaniel was, no doubt, expecting this decision.
He will, I hope, carry on and continue to fight for real reform in the Republican party.
This was the ruling that I was resigned to expect. Does anyone know why the three recusals?
This “Battle of Mississippi” was a victory for the GOPe RINOs and a defeat for constitutional conservatives (AND the majority of Republican voters in Mississippi).
Although the GOPe won this battle, the CORRUPT ACTIONS they had to take grievously wounded them for the long term. They exposed their rot and their vileness and their lack of both character and a core belief in ANYTHING except personal power.
The GOPe VILENESS exposed in Mississippi convinced me (and undoubtably 100s of thousands of other true conservatives) to change from a person who always voted for the “lesser of two evils” to one who will never again vote for a corrupt RINO. The damage they have done to themselves (and the Republican Party) will likely have minimum effect in the 2014 mid-terms but may have a substantial effect in the longer term and in closer elections. I hope they’re happy with the temporary victory they’ve won.

No reason was stated, but they also recused from the earlier case (where McDaniel was seeking access to voter records). Someone who knows Mississippi politics may correct me, but I always assumed it was because Cochran endorsed them when they ran for the court.

There wasn’t a deadline per se. However, they first had to fight to see the election information so they had grounds to file, with everyone in the establishment arrayed against them. It will not surprise me to see Cochran lose as bitter voters do not support him.
