IRS notches legal victory in tea party cases

The IRS may have inadvertently figured out how to win its legal battles against aggrieved tea party groups: Give them what they wanted in the first place — tax-exempt status.

That was a major reason a Republican-appointed federal judge on Thursday threw out two lawsuits brought by more than 40 conservative groups seeking remedies for being singled out in the tea party targeting scandal, a victory for the IRS.

..........as most freepers know, perhaps all, there are 3 branches of government. They are the judiciary, legislative and Executive.

This fight as the judge saw it was a fight between all 3 branches. Basically he is saying, as the representative of the judiciary..........”hey legislature!......do your job and rein in the IRS (Executive Branch)! Don’t leave it up to me!”

I don’t agree with his decision because these people were clearly abused and damaged. So, I don’t think HE did HIS job. But, I do think that or something close is what he was thinking.

“No ongoing injury” ISN’T the issue; it’s ALL about PAST injury.

If “not ongoing” is the standard for injury, no bodily injury claim in this nation could stand once the injured party was healed up. “Oh, yes, you did have a compound fracture to your left femur that kept you laid up for eight weeks, but it’s better, now, so we’re not liable anymore.”

Oh, yeah — THAT’LL fly!

Judge Reggie Walton of the U.S. District Court of the District of Columbia dismissed almost all counts brought against the tax-collecting agency in two cases, ruling that both were essentially moot now that the IRS granted the groups their tax-exempt status that had been held up for years.

Stupid judge - I wonder if he was asked if he would rule for a person who kept going 50 MPH in a 30 MPH zone, because the person decided to finally obey the law and stop speeding. I guess a crime never happened if the person/agency stops committing it somewhere down the road.

Right. Now the Tea Party groups are free to educate the voters on the issues facing us in 2012. Can the voters go back in time and change their votes?

No, it’s more like your life insurance company illegally cancels your policy while you’re undergoing cancer treatment. After you die from lack of medical care, they reinstate your policy. “No harm, no foul.”

I’m unclear how resolving the underlying issues (tax exempt status) clears away the legal issue (illegal politically motivated delay in processing the application)?

Good ruling and the first step to religious rights for owners of companies. Why would incorporation force you to lose a single right you retain as an American citizen?
