Can it be at the right altitude for an EMP attack?
The Muslims will ALWAYS go after the economy, and an EMP would destroy the entire country in a slow painful death that would allow their operatives to take possession of the country very quickly.
Think iran, china, pakistan, russia and probably several unknowns that hold nukes.
Do you (or anybody else) know if the transponder can be taken off a commercial plane, so that the plane is invisible to radar?
If this is possible, we are sitting ducks.
A clue of where is safety will be in observing where numerous people are during this next days, weeks, and months. Everyone knows whom am speaking of ... Hear us yet D.C.?

IS, if they give the warning at all, will probably wait until the last minute.
I imagine future Mode C transponders will allow the pilot only temporary disabling of it functioning, say for 1 minute, before it would automatically go back to doing its thang. (There are limited, useful tasks for a temporarily turned-off transponder.)
Primary radar returns--what radar shows if there is no functioning transponder--would be sufficient for controllers to be properly suspicious and allow the military to be alerted for a fighter intercept.
If commandeered jets approach our borders without fully functioning transponders, our military will not be easily in the dark or unable to deal with the threat. And it would have been a waste of time for any baddie to have repainted the Libyan or Malaysian craft with United Airlines colors. :)

Is a transponder a physical thing that can be removed? I know a plane couldn’t fly LEGALLY without it, but could it PHYSICALLY fly? Terrorists would just take off from some place in the boonies without telling anybody they’re taking off and wouldn’t care at all whether they were flying legally - IF there was a way to physically remove the transponder from the plane and still be able to fly. Do you know if that is possible?
