Gov. Perry stripped of his right to conceal carry and buy ammo

For those of you who’ve been sleeping since it happened Friday, Travis County grand jurors indicted Perry on charges of abuse of official capacity and coercion of a public servant. The first count carries a possible prison term of five to 99 years. The second, two to 10. I’m no expert on law or math, but I believe those potential sentences each exceed one year.

And there’s more. As an indictee, Perry’s state-issued Concealed Handgun License, assuming he still has one — his office didn’t know as of Tuesday afternoon — will be suspended until the case against him is decided. (Cue the cheering coyotes.)

The indictment’s impact on Perry’s gun rights was brought to my attention by a former Democratic state legislator who seemed happy to point it out.

“I’m surprised that you haven’t analyzed the most significant and immediate impact of the governor’s indictment,” ex-state Sen. Steve Carriker, D-Roby, told me in an email including the applicable federal law.

Carriker also was most helpful in providing the official federal “Firearms Transaction Record Part 1” form, which must be filled in by firearms purchasers. Question 11b asks “Are you under indictment or information in any court for a felony, or any other crime, for which the judge could imprison you for more than one year?” (An information is a formal accusation of a crime by a prosecutor.)

For Perry that’s now a big ol’ yes. And yes means no new guns or ammo.

My son, now 38 yrs old, committed a non violent felony when he was 17. He did a little time, and went through probation just fine. He now has a family and has had a good job for years, making a lot of money and paying a lot of taxes. He started his own business a few years ago, and is still restricted by what he can do because he is a felon. When he moved his family to Dallas for business, they had a hard time finding someone that would rent to them because of his record. (They own their own home in the town they moved from) He cannot vote nor own a gun.

a person who is finally convicted of a felony is not eligible to register to vote. Pursuant to Section 11.002 of the Texas Election Code, once a felon has successfully completed his or her punishment, including any term of incarceration, parole, supervision, period of probation, or has been pardoned, then that person is immediately eligible to register to vote.

Native Texan here. Texas gun laws are much more restrictive than you'd believe if you just listened to the media or paid attention to stereotypes. There is no provision under Texas law for open carry of handguns at all (though you can open carry long guns). The author is wrong about ammunition though, as you don't have to sign anything to buy ammo.

Take bail or bond, take the restrictions. Don't let them think you did the crime if you can't do the time.

LE is always saying how folks 'can't beat the ride'.

And that's what this is. The justice system ride.

Can't drink, piss tests, no firearms, give up 4th amendment rights...

Thanks for the info. I guess I thought most Texans could open carry handguns as well as long guns. I guess I have idealistic views of Texas - which admittedly come from reading Texas freepers’ posts.

But DeLay and Perry had nothing to do with that, and the indictment trick was used in common to both parties of the redistricting that turned the Texas House delegation Republican for the first time since Reconstruction.

Governor Perry needs to ask for change of venue to my county. He'd be a hero once it's over. The ugly, lying, drunken, lezbo, spitting at LEO, liberal witch would be tarred and feathered too.

This reminds me of the book and movie by David Wilkerson, “The Sword and the Switchblade.” He felt led to go to New York and attend a trial of street thugs where he was ultimately carried and thrown out of court. The next day’s headlines had his picture on the front page and it gave him street cred with the gangs and thugs - and subsequently, he opened “Teen Challenge,” and was very successful in preaching to gang members. Most notably Nicki Cruz. Great book if you want to read it. Pat Boone starred in the movie, but in all honesty - it just didn’t carry the same conviction for me as the book. This could work to Governor Perry’s advantage and possibly God’s ultimate will for him. I’m not God, so I don’t know, but, I’ll just sit on the sidelines and watch what transpires. I’m also reminded of Daniel, who was thrown in the lion’s den. Same result!

I wish this forum had an edit button. The name of the movie and book was “The Cross and The Switchblade.” My error - sorry! I mixed up the metaphor of the Word of God being likened to a two-edged sword.
