The DA must be pushing for the max charge/sentence where the jury has the right to convict on a lesser charge.

That makes sense to me. In any event - this man should serve jail time.

Then there’s no disincentive for overcharging. If I were on the jury in such a state and thought that the prosecutor had intentionally overcharged to play the odds, I’d create one. I’d vote to either convict of less than what I thought he was guilty of, or to acquit completely.
