Three judge panel — the two judges who wrote the opinion are Dems — however one of those judges, Roger Gregory, (originally appointed by Clinton) was elevated to the Fourth Circuit by George W. Bush!!! So we have W. to thank for this. What kind of GOP President appoints liberal Democrats to appeals courts?
Unfortunately, the way the USSC decided last year, this wave of decisions was inevitable. We can blame Bush for this particular judge, but we can blame Anthony Kennedy for voting with the leftists and writing a completely terrible decision.
IT was a 2-1 decision.
Judge Paul Niemeyer saw it otherwise, dissenting from the decision and writing, Because there is no fundamental right to same-sex marriage and there are rational reasons for not recognizing it, just as there are rational reasons for recognizing it, I conclude that we, in the Third Branch, must allow the States to enact legislation on the subject in accordance with their political processes.
Unfortunately, the kind I voted for twice. And to add insult to injury, I voted for John McCain and Mitt Romney the other two times. I learned my lesson after Romney. Never again will I fall for their line of, “Vote for our guy or the Democrat wins”.

The common, sorry ass DEMOCRAT Attorney General of North Carolina by the name of Roy Cooper now says as a result of this ruling he will not defend real marriage in court. This is the same weasel POS that has said for years he would defend the law as long as he was state AG. Roy Obama Cooper also wants to run for governor. He can kiss that goodbye. Two short years ago North Carolina VOTED an amendment into the State Constitution saying marriage is one man and one woman. So a word to anyone that lives in a state with a democrat sitting in the Attoney General office. It’s a matter of time because the worthless bastard says he will not defend marriage in the state if it does not allow queers to get “married”. They all have marching orders from Eric Holder.
One more reason I didn’t support the guy. He didn’t know his ass from a hole in the ground. Sadly, his advisers were many times worse than that too.
