As far as the law is concerned, it is the same thing. It will get you 3 to 5 year vacation as a guest of the State in most places. More in others. Don’t believe it? Try it and let us know how it ends. Heck, they may even put you on COPS.

As you can clearly see, he was surrounded -- surrounded -- by empty seats. He could have moved to any of them. He could have demanded his money back and left the theater, if the manager would do nothing. But he chose to be a hard guy. Now he should do hard time.

It's not like they couldn't tap his phone and his computer either if he is suspected of hatching some plot against the witnesses. That sounds pretty far fetched anyway. He's not some big mob boss with a crew of people sworn in blood to be loyal to him. Who would collude with him? Some of his old retired cop friends? They're going to risk prison to help him beat the rap of shooting someone in a movie theater? That's a crazy idea.
Whatever. It’s a ridiculous concern whether he’s in jail or out.
You seem to think this is up to you. It isn't. It isn't legally justified self-defense if he wasn't defending against a deadly threat. Whether you think that makes sense or not it is the law.
The one saving grace in this is that one of the witnesses against him is right there in the house with him.
And she is going to own him like never before and I don’t think he is going to like it one bit.
And even if the guy had a serious brain malfunction impelling him to kill at the first sight of flung popcorn, he is still guilty of manslaughter. He still was packing when he shouldn't have been. He still, by your own post, expressed horror at his own choices after he killed a man. And he deserves to be punished for not having developed self-control, especially after having sworn to "protect and serve" all those years. Face it. Even if he had run over a man with a car "by accident" because he's old, he would face jail time. And would deserve it.
Don't pick a fight if you are an old man otherwise you might just find yourself spending your golden years in the greybar retirement home.

That's some comfort, or karma. But she is also going to watch their life savings go down the drain, and worry about her old age and the humiliation of having to turn to her grown kids to take care of her when she's broke. No winners here.
