A definitive court ruling that subsidies provided through the federal exchanges are illegal would likely deliver a fatal blow to the insurance program since it was designed to extend health coverage to millions of low-income people who couldnt afford it without subsidies or tax credits. I dont have a crystal ball, Tribe said in discussing the laws chances should it reach the Supreme Court for yet another critical review. But I wouldnt bet the family farm on this coming out in a way that preserves Obamacare.

It never was designed to survive. Barry’s Tattooed Kiddie Invasion is going to put the final nail in the coffin of ObamaCare.
Now, about Ben Carson's "Health Savings Account" idea.....
I don’t understand why people think Obamacare will “fail.”
Yes, its an expensive complete joke, and hurts far more tax-paying Americans than those it helps.
but that is the case with many government programs. I don’t expect so-called “legislators” to do anything about it.
The Federal Reserve has a printing press, and they will use it to support big government in all its forms.
Maybe this was Robert’s plan all along to gut it and strangle it and leave it like a corpse hanging in the wind.

I wish I had your confidence in the “integrity” of our court system and the “cleverness” of Justice Roberts.
But I don’t.
I fully expect a split decision based on an “Intent of Congress” ruling in favor of the status quo.
Dems are having second thoughts about employer mandate. So the SCOTUS gut one funding source, the Dems repeal the other funding sources and taxes, problem is Obamacare still doles out the benefits. It will end up very little benefits will be repealed and most onerous taxes to fund it will be repealed. Net effect will be medical insurance for the poor with no revenue stream to pay for it. Instead of dying, the gov will avoid taking the benefits away and fund it by borrowing.
I agree. Hoping for a Constitutionally-based ruling at his point is, in my opinion, hopeless optimism.
Why did Roberts need to be “clever” and aid in the incredible damage done to our health care system and country when he could simply done the right thing the first time and struck this abominable law down?
I’d like to think that was the case but he could have spared the country this chaos and monumental expense had he held firm on the first decision.
The article calls it an “insurance program” then says it was designed to provide “healthcare”. When is someone going to point out that those are two different things.
Another clutching at straws article. Obamacare is here to stay. It may be fixed, but there is no way the Dems or SCOTUS will let it be killed.
Agreed.
This was the original plan anyway. They cobbled together all of these taxes to sell the program. As you indicate, one by one these taxes and mandates will be removed which will make Obamacare similar to Medicaid. The ends justifies the means.
Because it was designed to fail from the beginning. OOPS! Looks like an "unforeseen" issue with obummercare, and the only way to fix it is single payer! Mission accomplished.
You could argue that as long as a state triggers it by asking the federal government to come in [and establish insurance exchanges] that its a state-established exchange, even though its a federally run exchange, Tribe added. That might give some of the justices who arent strict constructionists some leeway in looking beyond the laws specific language, he said.”
That is exactly what will happen, the courts will rewrite the law to save O’bastard’s failed program.
That's not happening anymore.
Twenty years from now, if Obamacare hasn't been replaced by Single Payer, we will rarely hear about the unconstitutionality of Obamacare.
We don't subsidize food for the poor through the grocery store. We give the poor food EBT cards and let the grocery charge full price.
He's either a sop susceptible to the emotions of the cultural pressure in DC or he was blackmailed to make him change his vote on "health care".
I no longer trust the man in any case, he damaged his reputation greatly and at this point may not even know it.
I’ve said that for 8 years.
I say it all the time.
I never pass up an oppotunity to say it.
Health insurance and heath care are 2 different things.
Say it often. Say it everywhere.
And we also limit what items they can buy with their SNAP and WIC cards.
But apparently with Obamacare, that cannot be done.
Nah. Here’s the ting on that. This will be just a panel decision. The new makeup of the enbanc of the DC Cir (following filibuster reform) will ensure this fails. And I would be truly stunned of SCOTUS ruled in our favor on this one. Any SCOTUS decision on this is at least 2 years away.
In short .. don’t get your hopes up.
