Miss. GOP certifies Cochran victory over McDaniel

JACKSON, Miss. — U.S. Sen. Thad Cochran won the state's Republican primary runoff over challenger Chris McDaniel by 7,667 votes, according to a certification made by the state Republican Party and submitted to the Secretary of State on Monday, the legal deadline.

The result was wider than the 6,800-vote win counted by The Associated Press after the June election. Tallies usually change as county parties examine provisional ballots and finalize results....

The establishment GOP doesn’t care any longer about the GOP base. The base is not needed. In effect the establishment GOP have been bought and paid for by the same entities that bought and paid for the democrats. Their goal is to keep conservatives out of Congress or at least out of the Senate.

There are election laws on the books that keep McDaniel from accessing the ballot as an independent or as a write-in. But federal courts almost always rule against states when candidates are serious and well-supported. McDaniel will need to get a TRO with a federal injunction order to run as an independent or as a write-in. This is not difficult to do and it does not take a long time. Federal courts will not allow Mississippi to disenfranchise hundreds and hundreds of thousands of voters using state election law that is based on order and manageability of elections rather than the right of the people to nominate the candidate they think best represents them. Case law highly favors McDaniel in this.

But before going to federal court over ballot access we first wait until the state election challenge is ruled on.

What would those who scaled the cliffs on D Day thought of all this defeatism? Those guys fought a truely overwhelming force.

It’s shameful that we so easily toss aside their sacrifices.

It would be if the appointee term is more than two years. If Cochran resigned say six months
into his new term the appointee would serve until the next federal general election. At that
point a new election would be held for the remaining four years of the term.

Any party should be able to nominate any candidate they want and the rules for ballot access should be the same for all parties and independents, not one set of rules for Republicans and Democrats and another set for everyone else.

If there is a hint of prosecutor involvement, then Cochran risks being kicked out of Congress, losing his pension and perks of congressional retirement. He will likely come up with an excuse of health to resign.

Is the table being set? Why else report this now?

Yes you could be right so the McDaniel camp must be as wise as serpents and do all they can to select the best court and the best judge. I don’t know the rules in Mississippi but here in Washington State when a judge is randomly selected, hopefully randomly selected, then the parties have a one time option to request a new judge. So if for example an attorney knows that the judge selected to hear his case is really a wrong choice, that attorney has one more chance to get a new judge.

If the first or second judge is known and is known to be pro-Cochran such as having contributed to his campaign or to the MS GOP, then a motion to have the judge recuse themself can be made.

Now if all options are used up and there is no other option in state court, then McDaniel’s attorney can take a short walk over to the federal courthouse and file an emergency federal injunction to allow McDaniel onto the November ballot as an independent (past the deadline) or as a write-in candidate (barred by MS state election law to candidates who ran in the primary).

McDaniel can have his federal injunction within 2 weeks and he will have a very very good chance to win because the majority of republicans will vote for him and the democrats that were brought out in force for Cochran likely won’t be there the next go-round.
