BREAKING! There May Be Enough Invalidated Votes to Overturn Cochran Victory

The Chris McDaniel campaign has identified multiple Mississippi counties in which enough improper ballots have been cast that a legal challenge to the outcome of the election is warranted.

Ummm, the state law is setup so that if no candidate gets a majority (50% +1) in the primary, then there will be one runoff between the top two. Neither Cochran nor McDaniels got as much as 50% in the primary, hence the runoff. This is normal, not something caused by McDaniel or Cochran.

Cochran's handlers would be happy to have the result stand.

When they were investigating all the fraud going on in WI during the Scott Walker campaign, volunteers helped right from home. We signed up and they had us checking pages of recall petitions and it was unbelievable how sloppy blatantly false they were. It was an eye opener for me. I hope they can secure those votes and sign in sheets in MS and are able to verify them. The GOP should be ASHAMED of themselves stooping to this low against a fellow Republican.

I follow your logic - to a certain extent - but I don’t see how one uses statistics to conduct a recount. What you say may convince a judge that a recount is needed but how does one actually compute the new results? It would seem that would have to be done one vote at a time.

Yes, I’m aware of the requirement for a runoff. I was addressing the possibility of yet another runoff if this one is tossed out, as now looks possible.

NO, NO, NO. It’s not a record of whether a person voted...it’s a record of which registered voters WERE GIVEN A DEMOCRAT PRIMARY BALLOT ON JUNE 23RD. It’s a little hard to believe, but not everyone who is given a ballot votes; sometimes (but rarely) they simply walk out of the precinct door without voting (late to work? hot date?).

I think the GOPe thinks that a GOP loss to a democrat in this seat is not as bad as a GOPe loss to a conservative.

Agree. What other interpretation is there?

It's not a recount, it's invalidating the outcome with a certain degree of certainty. Recount won't work here, because some of the ballots, and we don't know which ones, were cast illegally. If the number of illegal ballots is lower than the margin of victory, then the illegal ballots don;t change the outcome, even if all of them were cast for the winner.

And you never get any precise result, like you do with counting. You get an estimated count with a margin of error and a confidence level. At some margin of error and confidence level, you'd be justified in changing the outcome. I gave a hypothetical example above. Margin of victory is 2,000; contest was roughly 50-50. There are 5,000 invalid ballots. I can say with very very high confidence that the number of ballots for the winner is between 2,400 and 2,600; and with even greater confidence, say the number for the winner is more than the margin of victory. I can't tell you an exact number - like you'd get in a count. But I can be damn certain that the contest was called incorrectly.

The counterargument is that the invalid ballots went primary to the loser - that is, that invalid ballots aren't split between winner and loser the same way the total/outcome is. The winner argues that all the invalid ballots went to the loser.

It's not Cochran's fault that the election workers don't do their job properly. If you are the judge, you can decide not to have another runoff, so any cost to the taxpayers is on your shoulders.

I am late to the game but I spotted this:

UPDATE: The Cochran campaign is reportedly asking county clerks not to certify the voting rolls until the last day possible so that the McDaniel people will not be able to look at the rolls and challenge them.

What’s up with that. Anybody know?

Whatever the judge wants to happen. Assuming the number of illgal ballots is greater than the margin of victory, the outcome is legitimately in question. At that point, if the judge decides he wants the election to go to Cochran, then the election results stand on whatever rationale the judge cooks up.

Law is an outcome driven process. There are enough precedents out there that any court decision can go either way. Judges pick the outcome, then write the opinion.

If I were a betting woman (I am not), I’d bet there are more than a few illegal votes in my county. The book that recorded our signatures was on line 300 something (low/mid 300’s) when i voted about 30m before polls closed on June 3. When I voted at the SAME time on June 24, my signature was number 570 something. I knew then the gig was up with mcdaniel. I didn’t know it would be so close though. Based on the numbers at MY polling place I figured Cochran would win by 5 or 6% maybe more
