That is the obvious solution, and I’d bet if hewas impeached prior to the November election, ther would be a significant number of Democrats that would vote for impeachment. Would likely even get some Democrats in the Senate to convict, but certainly a 2/3 to oust him would be impossible.

That is still no reason not to uphold and defend the constitution.

Agree. It isn't the duty of Scotus to fill in for congress. Thanks to the 17th Amendment we have redundant democratic houses in congress. All of them are wary of making any decision that could inflame the passions of any constituents and jeopardize their reelection this fall.

The hundred year effect of the 17th has made the congress institutionally incapable of doing its duty.

I agree. Can you imagine the chaos if the House would sue the President? This week and this issue, next week and another issue. The Founders did, and chose to have an impeachment, trial and verdict as outlined in the Constitution.
This bogus lawsuit is a diversion, distraction and ploy to cover ideological agreement of Mr. Boehner and the Mainstream Republicans with Mr. Obama.
Would it not be in Mr. Obamas interest to draw this fiasco out as long as possible, milking all the possible humor out of the Republican suit?
Conservatives who support and finance Mainstream Republicans, deserve the political, social and economic whippings they have received. But wait, there may be more t come.
