It's actually much worse than that, because the chief lied to detectives appointed by the DA to investigate the crime; he didn't tell the truth until his computer was examined. It's likely there was also spoliation of evidence there as well, and he just wasn't bright enough to cover his tracks.
In any event, he should be facing obstruction charges as well as identity theft.
