The U.S. Supreme Court upheld Michigan's controversial ban on affirmative action in public college admissions in a divided opinion released Tuesday morning, preserving a status quo that's contributed to dwindling minority enrollment at the state's flagship colleges.
The high court's decision is a blow to the University of Michigan in Ann Arbor, which has come under fire for low minority enrollment.
Blacks comprise just 4.6 percent of undergraduates this year, compared to 8.9 percent in 1995 and 7 percent in 2006.
University of Michigan President Mary Sue Coleman and admissions director Ted Spencer have decried the affirmative action ban, saying outright that the school cannot achieve a fully diverse student body with it in place.
"It's impossible," Spencer said in a recent interview, "to achieve diversity on a regular basis if race cannot be used as one of many factors."
Fifty-eight percent of Michigan voters in 2006 passed Proposal 2, a ballot initiative that amended the state constitution and made it illegal for state entities to consider race in admissions and hiring. With the Supreme Court's ruling, the only way left to nullify Proposal 2 is to mount a long, expensive and uncertain campaign to overturn it.

Basically, Breyer opines that the Constitution allows affirmative action, but does not require it.
This is in contrast with the “wise lesbotina” who says affirmative action is required by the Constitution.

What else can we expect?
AA is illegal, unconstitutional, and unjust. It rewards failure and indolence. It penalizes successful people for possessing an irrelevant characteristic: light skin.

What a crock. The only hope is NOT overturning Proposal 2.
The only HOPE is improving the education of Blacks applying for entry in Michigan.
And, moreover, those Blacks who are accepted will actually be among the best at what they do, so they'll learn, produce, and gain respect.
Go BACK to the 3 R's. Approve vouchers to better public, charter, and private schools....defy the unions.
Look to the European model that produces exemplary black students, and realize that CULTURE is a huge issue here. If you want excellence, then promote cultural excellence.
Bingo: Kagan recused herself because the outcome wasn’t in doubt... like it was for the Obamacare decision. That bites.

You would be correct. The Federal government is the most egregious violator of discrimination.

I guess for the media, anything short of unanimity is a “divided court”. They’re such open liars.
But this line. Please. What is contributing to the "dwindling minority enrollment" is the dwindling number of minority candidates who are qualified.
An honest media would write a headline to reflect the truth. Such as:
“USSC Prohibits discrimination based on Race!”
Either we cab discriminate based on race, or we can’t.
One of the worst effects of "affirmative action" is that those admitted lack the academic wherewithal to succeed, and often drop out from a top-tier school when they would have finished if they had gone elsewhere.
But the mainly white administrators don't care about that or about how many deserving whites or Asians were denied admission so they could trumpet their leftist bona fides.
