Nevada rancher's son freed, BLM collecting cattle

LAS VEGAS -- The son of a rural Nevada cattle rancher has been freed from federal custody, a day after his arrest by agents working to remove cattle from disputed grazing areas northeast of Las Vegas.

A U.S. attorney's office spokeswoman in Las Vegas said Monday that 37-year-old Dave Bundy is accused of refusing to disperse and resisting officers.Bundy's mother, Carol Bundy, says U.S. Bureau of Land Management agents arrested her son Sunday in a parked car on State Route 170 near Bunkerville.

Pictures obtained by the 8 News NOW I-Team show where David Bundy had parked his car to take pictures of the cattle eviction.

Bundy says he was only exercising his First Amendment rights when federal officers told him to leave  the area and when he didn't, they grabbed him."Two officers surround me, third one in front of me. They jumped me and took me to the ground. You can see they scraped up my face," Bundy said.Bundy's father, Cliven Bundy, says his cattle are entitled to graze in the Gold Butte area."They steal my cattle, and that is bad enough. But they make my son a political prisoner," Cliven Bundy said. 

This weekend wranglers, hired by the federal government, started  removing cattle owned by Bundy from a stretch of land near the Virgin River Gorge.

Wrong again Sparky. Nevada vehicle codes apply to many Federal roads on both BLM and Forest Service land. Nevada water rights law apply to the same Federal lands. I could go on but you’ll just ignore it or parse some other BS. BTW I live in Nevada as does B4Ranch. I spend over 100 days a year in the outback.

Federal Water rights are allowed to be adjudicated in state courts because Congress’s passage of the McCarren amendment. And as for the vehicular laws, the BLM has a specific provision that says it is illegal to violate state traffic laws. Authority still remains with Congress and can be revoked at any time. Further, any authority not distributed to the state is automatically retained by Congress.

Just to clarify my prior comment - “Nevada state laws do not restrict how the US Government run’s it’s own land.” Your interpretation of what I said, while plausible, was not in keeping with the spirit of the conversation.

I will give you an example from Leavenworth, KS. The fort was in existence before the state. The land on the fort is US Government land. Technically, no police officer of the state can enter Ft Leavenworth with permission of the Provost Marshal. In fact, violations of law (even traffic violations) are not resolved in city or county court. They are resolved the US Magistrate court due to this separation. I know, I got a parking ticket.

The State of Kansas can make all the laws that they want about how the land is to be used but they do not have any means of enforcement without that agreement. While there may be agreements in place, they do not carry the weight of law.

You seem to be impervious to the fact that the federal government is a lying bully which uses its unlimited funds and innumerable gunthugs to push its victims around.

In my world, the federal government has to prove beyond a reasonable doubt that they're not lying about anything they're involved in, since that's all they ever do.

My assumption in this case is that they changed the rules after the fact, and are lying about it.

Don't pretend to be stupid about how "bully government" works.

This Bundy is the last of a number of ranchers that used that land for cattle. It "became a problem" 20 years ago, according one of your own posts. Oddly, before that, it wasn't a problem.

1994. Hmmmmmmmmmmmm. Gosh, wasn't Bill "Unprosecuted Perjuring Felon & Escalante National Monument Land-Grab Boy" Clinton the president back then?

It's sad that governments are chiefed by the double-tongues.

It's even sadder that supposed conservatives are willing to defend the lawless actions of the double-tongues.

That’s an awful broad interpretation of Article 1 section 8 give that it wasn’t purchased with consent of the legislature for the purposes of forts, etc...

Article V of the treaty of Guadalupe Hidalgo merely describes the new U.S.–Mexico border. The state of Nevada should by all rights have been encumbered with the vast majority of the states land either through cession to same from the government, or the allowance of general purchase to the state/public (which was done in small increments under 1872 mining law until the Clintoon moratorium on issuance of Patents).

Things like visitor centers and maintenance buildings are common on government lands out west.

Interesting. There doesn't seem to be any on the 10,000 or so acres in the immediate vicinity of my section...

Interestingly, when Clintoon locked up the Escalante Monument (and its low-sulfur coal, for his Indonesian buddies), it was the first National Park/Monument administered by the BLM. Imagine that.
